SPP/APR C-8: Requirements • Indicator 8: Percent of all children exiting Part C who received timely transition planning to support the child’s transition to preschool and other appropriate community services by their third birthday including: • IFSPs withtransition stepsand services; • Notificationto LEA, if child potentially eligible for Part B; and • Transition conference, if child potentially eligible for Part B. FAQ LEA Notification – Step 2 Step 2: Notification of children deemed “potentially eligible” for Part B • Children individually determined by IFSP team based on states’ definition of potentially eligible • Considered a referral to Part B • Parental consent cannot be obtain (different than declining under opt-out policy) • Part B provides procedural safeguards to parents and attends transition conference • LEA notification must be provided even if parent does not approve convening transition conference (unless OSEP-approved opt-out policy in place) Western Regional Resource Center APR Clinic 2010

FAQ LEA Notification & Opt-Out Policy • May adopt an opt-out policy that permits parent to “opt-out” of the referral within a certain time period • Opt-out policy must be in writing and on file with OSEP as part of State Application Reporting: • NOT required to include in calculation (numerator or denominator) # of children for whom parents opted-out • State must include in narrative # of parents who opted-out Western Regional Resource Center APR Clinic 2010

FAQ Transition Conference Requirements • Develop or revise Transition Plan • If Part B does not participate, Part C must provide information about Part B to parent • If parent does not approve convening transition conference, LEA notification must be provided (unless OSEP-approved opt-out policy in place) Western Regional Resource Center APR Clinic 2010
Transition Conference Reporting: • Do not include # if family did not approve conference • Include total # for whom transition conferences were not timely and reasons for delays (include in denominator, but not numerator) • Not required to include # delayed due to exceptional family circumstances (if include, must be in both numerator and denominator) • report # of delays separately in discussion • Must include in denominator but not in numerator, # of delays other than exceptional family circumstances that are within or outside of EIS control, e.g., weather. • describe delay reasons and #s under progress/slippage Western Regional Resource Center APR Clinic 2010

B-12 Early Childhood Transition Measurement • # of children who have been served in Part C and referred to Part B for eligibility determination • # of those referred determined to be NOT eligible and whose eligibility was determined prior to their third birthdays • # of those found eligible who have an IEP developed and implemented by their third birthdays • # of children for whom parent refusal to provide consent caused delays in evaluation or initial services • # of children who were referred to Part C less than 90 days before their third birthday Western Regional Resource Center APR Clinic 2010
B-12 Early Childhood Transition Measurement • Account for children included in a, but not included in b, c, d or e • Indicate range of days beyond third birthday when eligibility was determined and IEP developed and reasons for delays • Percent = [(c) divided by (a – b – d- e)] times 100 • Use data from monitoring (describe how LEA selected for monitoring) or state data system Western Regional Resource Center APR Clinic 2010

FAQ - Early Childhood Transition • Procedural safeguards must be provided to all children served in Part C who are referred to Part B (referral = LEA notification of potentially eligible) • For children with summer birthdays, the IEP initiation date may be beginning of school year if ESY not needed • Date LEA Notification received does not begin 60 day (or state) timeline for completing evaluation (but rather parent consent does) • If parent requests, LEA must invite Part C service coordinator to initial IEP meeting • LEA cannot use a state exception to state timeline for evaluation to extend the development an IEP by age 3 (IEP by age 3 not required for Late Referrals to Part C) Western Regional Resource Center APR Clinic 2010
FAQ – Late Referrals to Part C Part B Responsibilities • For children referred to Part C ≤ 90 days from child’s 3rd birthday and “served” by Part C, Part B: • Conduct initial evaluation within 60 days or other state timelines (even if timeline expires after 3rd birthday) • Conduct IEP Meeting (30 days from eligibility determination) Western Regional Resource Center APR Clinic 2010
