Stipulated Settlement Agreement • Creation of new policy: FLUE Policy 1.1.12.1.1 • Includes densities and intensities for all PD land use amendments • Transportation Policy 1.4.2 • For projects that degrade the roadway level-of-service below the adopted level-of-service standard, development permits shall not be issued unless (1) the facility impacted is on the County’s five-year capital improvement schedule; or (2) scheduled for construction within the fourth or fifth year of the County’s 5-year capital improvements schedule, in which case the County will calculate and approve a proportionate fair share contribution based on the formula in the Orange County Code; or (3) if the facility is scheduled for completion within years 6 through 10 of the County’s 10-year roadway program, then the County at its discretion may approve a proportionate fair share contribution based on the formula in the Orange County Code.
