3. Getting to Know the Players… • George: 4-4 transfer. Leaving Division I institution. • Floyd: 4-4 transfer. Disciplinary suspension – institutional ‘doping’ issues. • Greg: 4-2-4 transfer. Looking to increase GPA at two-year college. • Lance: French exchange student. • Evelyn: Pursuing second baccalaureate at second institution.

5. George • Currently enrolled at a Division I institution. • First enrolled at the Division I institution fall 2005-06 and went full time each semester he was enrolled. • Took a year off (2006-07) to apprentice at a bike shop.

6. George • Never competed in any sport for the Division I school. • Wants to try out for your men’s soccer team.

7. George • Reached out directly to your coach. Your coach notified you and asked what to do. What are the questions and sequential steps?

8. George • Is George a transfer? • Officially registered and enrolled full time and attended class; • Attended any class while enrolled full time, even on provisional basis; • Enrolled full time in night school of institution and considered matriculated; • Enrolled in branch of institution and had been enrolled at another institution prior to branch school;

9. George • Attends a branch school and goes to another institution (not the parent institution); • Reported for a regular practice per team’s calendar; OR • Participated in practice or competition even though less than full time? Bylaw 14.5.2

10. George • Ask the coach if s/he has permission to contact. Why? (Note: Self release is not an option here. Why?) Bylaw 13.1.1.2

11. George 3. Begin communication with student and/or other institution’s compliance office. • Begin to ascertain eligibility at Division I institution. • Begin to establish what George’s history looks like.

12. George 4. Look at the General Rule (NCAA Division III Bylaw 14.5.5.1). Starting place: George serves an academic year in residence.

13. George 5. Look for a 4-4 exception (Bylaws 14.5.5.1.1 – 14.5.5.1.3) to the General Rule. Exception 1 (Bylaw 14.5.5.1.1(a)): Never used a Division III season AND never practiced or competed at a non-Division III institution. Could George use this exception? What needs to be verified?

14. George Exception 2 (Bylaw 14.5.5.1.1(b)): Left four-year college and would have been academically and athletically eligible had student remained. Could George use this exception? What needs to be verified?

15. George Exception 3 (Bylaw 14.5.5.1.2): Enrolled at your institution for a specified period of time as an exchange student. Needs to be part of an established educational exchange program recognized by your institution’s academic authorities. Could George use this exception? What needs to be verified?

16. George Exception 4 (Bylaw 14.5.5.1.3): Two years of nonparticipation. No intercollegiate participation AND no organized amateur competition while enrolled as a full-time student in collegiate institution. Could George use this exception? What needs to be verified?

17. George • So…may be able to use Exception 1 (not previously used a season) or Exception 4 (two-year nonparticipation). Strong potential his situation will meet a transfer exception.

19. George The Division I institution told you he was full time beginning fall 2005. • George used eight full-time semesters but is still within his first 10 full-time semesters allotment (Bylaw 14.2.2).

21. Floyd • Competed for a Division III men’s soccer team fall 2009. • Enrolled full time until November 1, 2009…when he was suspended immediately for cocaine use. • Suspended for remaining fall 2009 semester and entire spring 2010 semester.

22. Floyd • Will be allowed to re-enroll fall 2010 and will be both academically and athletically eligible at that time. • Rather than re-enroll at his original institution, Floyd chooses to transfer to your institution fall 2010. What are the questions and sequential steps?

23. Floyd • Is Floyd a transfer? • Do you need permission to contact. Why/why not? • Need to establish whether student-athlete is officially withdrawn from original institution. • If withdrawn, no need to seek permission to contact.

Floyd • Does Floyd meet any four-year college transfer exceptions or does he need to serve an academic year in residence? • Exception 1 (no season use): No. • Exception 2 (academic & athletic eligible): Maybe. Likely. • Exception 3 (exchange student): No. • Exception 4 (two-year nonparticipation): No.

25. Floyd 4. Need to also check semesters used and other eligibility criteria.

26. Floyd – StoryModification • Floyd decided not to re-enroll at any institution after getting kicked out without the opportunity to re-enroll at his original institution. • He went into pro cycling during this time and did not participate in any other sports.

27. Floyd – StoryModification • Floyd then enrolls at your institution fall 2011. • Is he eligible to compete immediately under the two-year nonparticipation exception? Does he meet a 4-4 transfer exception?

Floyd – StoryModification • Division III just passed legislation to allow a disciplinary suspended SA use the two-year nonparticipation exception (Bylaw 14.5.1.3.1/NCAA Division III Proposal No. 2010-2). • So…is he ready to go immediately in fall 2011 using Exception 4 (two-year nonparticipation)?

29. Floyd – StoryModification • NO. Ineligible because has not fulfilled the tenants of the two-year nonparticipation exception…the two years piece (Nov. 1, 2009 dismissed).

Greg • Started at a four-year college and competed for the lacrosse team. • Full-time semesters at original school: Fall 2008; spring 2009; and fall 2009. • In good academic and athletic standing. • Wants to go to another four-year immediately, but that school wants Greg to go to a two-year college and get GPA up as a condition of admissions acceptance.

32. Greg • So…spring 2010 full time at a two-year college. • Improves his grades and is accepted for a full-time program at his desired four-year school (your institution) for fall 2010. What are the questions and sequential steps?

36. Greg Exception 2 (Bylaw 14.5.4.1(b)): Left two-year college and would have been academically AND athletically eligible had student remained AND never attended a four-year college. Could Greg use this exception? What needs to be verified?

38. Greg Successfully completed at least 24-semester/36-quarter hours of transferrable credit at two-year college and spent at least two full-time semesters/three quarters at two-year college. Could Greg use this exception? What needs to be verified?

40. Lance • Exchange student from France. • In an undergrad program back home, but will be at your institution for the fall 2010 semester. • Used two basketball seasons at his home institution.

41. Lance • Also…participates on an amateur basketball team outside of home institution. • Enrolled in your institution’s exchange program – certified by your registrar and the dean. • Wants to compete for your men’s basketball team. What are the questions and sequential steps?

42. Lance • Is Lance a transfer? 2. Do you need permission to contact? • Do you need to obtain information on Lance from his home institution? What information are you looking for?

43. Lance 4. Does Lance meet any four-year college transfer exception or is he ineligible during his fall semester at your institution? • Exception 1 (no season use): No. • Exception 2 (academic & athletic eligible): Maybe. Difficult to figure out. • Exception 3 (exchange student): Yes. • Exception 4 (two-year nonparticipation): No.

46. Evelyn • Overachiever…she graduated in less than four years (spring 2010) and has a 4.0 GPA. • Never participated at the institution she received her undergraduate degree from. • Earned her degree without taking any breaks.

47. Evelyn • Seeking a second baccalaureate from your institution beginning fall 2010. • Wants to be immediately eligible to participate on your women’s volleyball team (fall sport). What are the questions and sequential steps?

50. Evelyn NO. Evelyn has graduated and has a degree from a different institution. Per Bylaw 14.1.9, she may not participate for your institution.
