Purpose of Workshop • Inform public about plans to amend transport regulations • Staff currently scheduled to recommend amendments to Board May 2003 • Discuss concepts under consideration • Provide opportunity for public input
Transport Mitigation Includes: • Air Quality Attainment Planning • Transportation Planning • Land Use Planning
California Clean Air Act (CCAA) Requirements ARB is required to: Assess Transport • Identify transport couples • Assess relative contribution of upwind emissions on downwind ozone concentrations Mitigation • Establish mitigation requirements
ARB Transport Activities • Transport assessments - 1990, 1993, 1996, 2001 • Mitigation requirements established in 1990 and amended in 1993 • Board directed staff to strengthen mitigation requirements- April 2001 • Workshop on mitigation strategies - June 2001 • Report to Board- July 2001
Current Mitigation Requirements • Sufficient measures based on modeling • Best Available Retrofit Control Technology (BARCT) on stationary sources
Need for Review • Board direction to strengthen mitigation regulation • Address equity issue • Some upwind areas have less stringent NSR permitting programs than their downwind neighbors • Acceleration of BARCT achieved • Timely implementation of innovation and technology
Concepts Under Consideration 1. New Source Review Program Require equal “no net increase” thresholds for upwind and downwind areas 2. All Feasible Measures Provide timely and ongoing assessment of All Feasible Measures
Overview of NSR Program New or Modified Source 1. Apply BACT * 2. Reanalyze potential to emit 3. Offset emissions (no net increase) YES Do Permitted Emissions Exceed Threshold? NO * Changes are not being proposed to BACT thresholds Comply with Existing District Rules
Why Require Equal“No Net Increase” Thresholds? • Current NSR threshold levels based on State ozone classification (BACT & “no net increase”) • NSR requirements not currently part of transport regulation • Different thresholds create inequity among transport couples • Differences exist in “no net increase thresholds” • Regional impact Bay Area/Sacramento/San Joaquin Valley
Concept 2:Facilitate Expeditious Adoption of All Feasible Measures
All Feasible Measures Requirements Under CCAA • CCAA’s Requirements • Achieve 5% reduction in district-wide emissions OR include all feasible measures in clean air plan • District reviews every 3 years and submits to ARB for approval • ARB provides technical assistance, guidance documents, and recommendations
Concept for All Feasible Measures • Ensure timely implementation of CCAA requirements already applicable to upwind districts • Require the most effective strategies within district’s legal authority • Incorporate mechanism for ongoing assessment of all feasible measures • Maintain both NOx and ROG pollutant strategies
