HAZARDOUS WASTE (HW) “Hazardous waste” means any waste which by reason of characteristics such as physical, chemical, biological, reactive, toxic, flammable, explosive or corrosive, causes danger or is likely to cause danger to health or environment, whether alone or in contact with other wastes or substances.

PROCESS TO OBTAIN CTO/CTE/AUTHORIZATION • Occupier and Operator engaged with hazardous waste should visit Online Consent Management and Monitoring System portal of Jharkhand State Pollution Control Board (JSPCB) www.advantage.jharkhand.gov.in or https://jhkocmms.nic.in/OCMMS/ or jspcb.nic.in • Uploading of desired documents and fees payment through Net Banking/Debit/Credit Card or RTGS/NEFT application will be submitted to JSPCB.
GRANT OF CTE • Consent is provided within 120 days, provided the application and the documents are in order. • Auto-renewal/ Extension of the period based on self-certification may be availed.
Documents required for CTE • Authorization to file application. • Environmental Clearance. • Mining Lease Copy ,if mining work would be involved. • Forest Clearance under Forest Conservation Act,1980. • Permission from NBWL. • Land Document .
Documents required for CTE • Proposed Industry to be shown on village map to the scale with marked battery point. • Certificate from concerned DFO regarding distance of forest from proposed site. • Estimated project cost including land, building, plant and machinery (without depreciation) duly certified by CA. • Detail budgetary provision for Environmental Management and Pollution Control Measures.
Documents required for CTE • Manufacturing process and process flow chart. • Process flow diagram and disposal for Effluent Treatment Plant with design details. • Details of Air Pollution source and proposed air pollution control measures. • An affidavit declaring that terms and conditions of the Board shall be abided by the PP.
Documents required for CTE • Self Declaration /Affidavit for procuring valid source of raw material . • Latitude and Longitude of the proposed site at four points of battery point. • AAQ analysis reports of proposed area at three points.
Expansion of project in Existing premises • Old CTE copy and current CTO copy with its compliance report. • Expansion EC if required. • AAQ report. • Proposed site is out of existing premises then, upload documents mentioned earlier.

Documents required for CTO • Authorization to file application. • EC copy with compliance report, if applicable. • Copy of CTE/CTO with compliance report (with required documents). • Copy of Authorization under Hazardous and Other Wastes Rules, 2016. • Details of Pollution Control Devices preferably with analysis reports of effluent/emission/Solid waste.
Documents required for CTO • Details of Air pollution Control Measures implemented. • Self declaration/affidavit for procuring valid source of raw material. • Environmental statement. • Affidavit certifying that no expansion/modernization in the plant has not been made after construction of the plant after obtaining CTE.
Documents required for CTO • Estimated project cost including cost of land, building, plant and machinery (without depreciation) duly certified by CA. • Land documents. • Latitude and longitude of the unit at four points. • Details of Effluent Treatment Plant with design, if applicable. • Detail of all sources of emission and fugitive emission and pollution control arrangements at its points.
GRANT OF AUTHORIZATION • Every occupier engaged in handling, generation, Collection, Treatment, Storage, Disposal, Reception, Reuse Recycling, Recovery, Pre-processing, Co -processing, Utilization, Transportation, Incineration, irrespective of the quantity shall make an application in Form 1. ( available on website )
DOCUMENTS REQUIRED FOR AUTHORIZATION • Authorization to file application. • Duly filled up application form. • Copy of valid CTO and its compliance. • Copy of valid CTE. • Registration by District Industry Centre, if Applicable. • Copy of Annual Return as per Form – 4.
DOCUMENTS REQUIRED FOR AUTHORIZATION • Previous Authorization copy its compliance report. • Details of Hazardous Waste Generation with category and Quantity. • Details of disposal facility of Hazardous Waste. • List of Facilities available for collection, storage, packing, transportation, treatment, processing, use , destruction etc... • Self certificate regarding “No storage of HW beyond 90 days”.
DOCUMENTS REQUIRED FOR AUTHORIZATION • Self Certificate regarding “ The labelling is being done as per Form 8 for safe handling, storage and transport of HW”. • Photocopy of Manifest (White for general). • Self Certificate regarding “Transportation of Hazardous and other waste as per the provisions of Rule 18 of H&OW Rules. • Details of technical capabilities and equipment as per CPCB guidelines. (For TSDF only) • Photocopy of Form 3. (For TSDF only)
GRANT OF AUTHORIZATION • Authorization to be decided within 120 days. • The authorisation is valid for 5 years. • An application for renewal of authorisation may be made three months before the expiry of such authorisation.
RESPONSIBILITIES OF OCCUPIER • An occupier shall follow the following steps, namely:- prevention, minimization, reuse, recycling, recovery, utilization including co-processing, safe disposal. • Shall be responsible for safe and environmentally sound management of hazardous and other wastes.
RESPONSIBILITIES OF OCCUPIER • Wastes generated shall be sent or sold to authorized disposal facility. • Wastes shall be transported authorized disposal facility in accordance with the provisions of these rules.
RESPONSIBILITIES OF OCCUPIER • Must give specific information for safe storage and disposal to the operator. • Steps to manage hazardous and other wastes to: (a) contain contaminants and prevent accidents and limit their consequences on human beings and the environment; and (b) provide persons working in the site with appropriate training, equipment and the information necessary to ensure their safety.
STORAGE OF HAZARDOUS WASTES • Occupiers of Facility may store Hazardous wastes for a period not exceeding 90 days and shall maintain a record of sale, transfer, storage, recycling, recovery, pre-processing, co-processing and utilization of such wastes. • But may be extended for small generators, actual users and disposal facility users upto 180days.
TREATMENT, STORAGE & DISPOSAL FACILITY • Operator of common facility shall design and set up the TSDF as per technical guidelines issued by the CPCB and shall obtain approval from the JSPCB for design and layout. • Operator of common facility shall be responsible for safe and environmentally sound operation of the facility and its closure and post closure phase, as per guidelines issued by CPCB from time to time.
TREATMENT,STORAGE & DISPOSAL FACILITY • The operator of common facility shall maintain records of hazardous and other wastes handled by them in Form 3. • The operator of common facility shall file an annual return in Form 4 to the JSPCB on or before the 30th day of June .
TSDF IN JHARKHAND • In Jharkhand there is one TSDF (Transport, Storage, Disposal Facility) at Jamshedpur - M/s Adityapur Waste Management Pvt. Limited (Hazardous Waste Management Facility), Mauza - Dugni, P.S – Dugni, District - Saraikela Kharsawan.
PACKAGING & LABELLING OF HW • Any occupier or operator of the TSDF shall ensure that the HW are packaged in a manner suitable for safe handling, storage and transport as per the guidelines issued by the CPCB from time to time. • The labelling shall be done as per Form-8. • The label shall be of non-washable material, weather proof and easily visible.
TRANSPORTATION OF HW • The transport of the HW shall be under the Motor Vehicles Act, 1988 and the guidelines issued by the CPCB from time to time. • The occupier shall provide the transporter with the relevant information in Form-9, regarding the hazardous nature.
TRANSPORTATION OF HW • Responsibility of safe transport shall be either of the sender or the receiver whosoever arranges the transport. • Responsibility should be clearly indicated in the manifest. • The authorisation for transport shall be obtained from JSPCB either by the sender or the receiver on whose behalf the transport is being arranged.
MANIFEST SYSTEM FOR HW • The sender of the waste shall prepare seven copies of the manifest in Form 10 comprising of colour code indicated below and all seven copies shall be signed by the sender:
ACCIDENT REPORTING • If an accident occurs at the facility of the occupier or operator of the disposal facility or during transportation, they shall immediately intimate the Jharkhand State Pollution Control Board through telephone, e-mail about the accident and subsequently send a report in Form 11.
ROLE OF JSPCB • Inventorization of hazardous and other wastes. • Grant and renewal of authorisation. • Monitoring of compliance of various provisions and conditions of permission including conditions of permission for issued by Ministry of Environment, Forest and Climate Change for exports and imports.
ROLE OF JSPCB • Examining the applications for imports submitted by the importers and forwarding the same to MOEFCC. • Implementation of programmes to prevent or reduce the generation of hazardous and other wastes. • Action against violations of these rules. • Any other function under these Rules assigned by Ministry of Environment, Forest and Climate Change from time to time.
