EMTALA. Medical Center Policy

1. Emergency Medical treatment and Labor Act ( EMTALA) To assure that all patients presenting to UMass Memorial Medical Center (UMMMC) requesting examination or treatment for an emergency medical condition receive an appropriate medical screening examination, stabilization, and if necessary, transfer in accordance with the Emergency Medical Treatment and Labor Act (EMTALA).
In accordance with EMTALA, it is UMMMC’s policy to provide a medical screening examination, stabilizing treatment and/or appropriate transfer as necessary.
UMMMC will not delay provision of an appropriate medical screening examination or further medical examination and treatment to stabilize the medical condition in order to inquire about the individual’s method of payment, insurance status, or to secure signatures on a financial responsibility or advanced beneficiary notification form. Request for insurance co-payments will not be made prior to a medical screening examination and stabilization.
2. EMTALA Medical Center Policy # 1095 Medical Screening , Transfers and Refusal of Care- EMTALA Compliance Guidelines
Medical Screening Examination: A medical screening examination is the process required to reach, with reasonable clinical confidence, the point at which it can be determined whether an emergency medical condition does or does not exist. When necessary, this includes the use of ancillary services routinely available to UMMMC. The examination must be provided by a physician or other qualified individuals who have been approved by the UMMMC Board of Trustees to perform such examinations.
3. EMTALA “Presents to UMMMC”: means that the individual is on UMMMC’s University or Memorial campus – where UMMMC’s Emergency Departments are located – or, on property adjacent to these campuses, including any sidewalk, parking lot or driveway on the University and Memorial campuses.
4. EMTALA Each Emergency Department shall maintain a central log that lists each person who comes to the Emergency Department for medical services. The log must specify with respect to each individual whether the individual: (i) refused treatment, (ii) was offered a transfer and refused such transfer, (iii) was refused treatment, (iv) was offered treatment and accepted, (v) was admitted and treated. The log may contain other information regarding arrival modes and times of care as deemed necessary by UMMMC.
5. EMTALA Posting of Signs
UMMMC’s Emergency Departments shall have signs conspicuously posted specifying the rights of individuals under the anti-dumping provisions of EMTALA with respect to examination and treatment for emergency medical conditions and women in labor. UMMMC shall also have signs conspicuously posted specifying that that hospital participates under the Medicaid program.
