Legal and Policy Task Force Legal & Policy • Responsibilities: • Strategic Plan • Address approach to privacy/security issues within and between states • State intentions to amend state laws, if any • Determine the proper legal team to identify and review the laws that impact HIE. • Create plan for amending state law • Illustrate approach to facilitated negotiations with other states and Federal medical entities. • Promulgate policies and procedures to foster data exchange • Develop standardized trust agreements to enable secure flow of information • Identify variations in partner trust agreements. • Identify approach to acts of non-compliance (with fed and state laws and other HIE policies) • Define boundaries of compliance
Legal and Policy Task Force Legal & Policy Responsibilities: Operational Plan • Describe and develop compliance and audit plan for all relevant policies and laws • Investigate existing audit systems and compliance processes • Eliminate conflicts with governance and oversight mechanisms • Describe plans for privacy and security harmonization and compliance statewide • Coordinate activities to establish consistency on an interstate basis • Ensure adherence to other federal laws that may exist for various participants such as VA, DoD, IHS, etc.
Legal and Policy Taskforce Major Milestones 1. Complete review of the laws that impact HIE by December 29, 2009. • Determine need for legislative action by January 13, 2010. • Deliver initial draft of policies and procedures for data exchange by March 31, 2010. • Deliver initial draft of standardized trust agreement by May 31, 2010.
Legal and Policy Taskforce Members Required Skill Sets: • Legal expertise from public and private entities/providers • Paralegals/interns • Clinical expertise • Information systems technical expertise • State and federal policy expertise • HISPC experience and interstate contacts
