Hypothesis • How did we come up with this theory? • The facts in this case are as follows: • Vanessa threatened Darryl with his job unless he didn’t stand into the hotel’s freezer. • Whilst in the freezer, Vanessa encouraged the other employees to belittle and mock him. • Later turns off the light, leaving him for several hours
False Imprisonment • An act or omission by defendant that causes a person of reasonable sensitivity to be confined for restrained. • Examples: • Vanessa, his boss, forced him to enter the freezer • Threatening him with the termination of his job • Said to him that she locked the door, turned off the lights and left him for several hours.
Slander • The defamation of one’s person by speaking. This tends to injure the plaintiff’s reputation and expose the plaintiff to public hatred. • Examples: • Vanessa makes fun of Darryl’s stutter and low intelligence • Vanessa encourages the other employees to join in. • Darryl was not able to defend himself at this time as he was imprisoned against his will.
Intentional Infliction of Emotional Distress (IIED) • Use of extreme and outrageous conduct that transcends all bounds of decency. • It is committed intentionally and the defendant must cause physical harm with emotional distress as a result. • Examples: • Darryl suffered severe frostbite and his toes and fingers
