  2. Guidelines for Revisions • Readily apparent changes, i.e., “low hanging fruit” that are long overdue • Convert prescriptive statements to broader policy statements • Propose delegation of authority to enhance operational efficiency and effectiveness

  3. Consultant Dr. Terry MacTaggert, Association of Governing Boards Reviewed draft proposed amendments from the perspectives of • “best practices” • accreditation standards

  4. Dr. MacTaggert’s comments on draft amendments • Update and clarify policies, enhancing understanding and potential for effective implementation • Provide for modest delegation of authority while the BOR retains full authority over critical functions • Conversion of BORP to executive policy assures continued oversight • In sum, changes are appropriate and consistent with best governance practice

Amemiya) • Allows authority delegated to the President to be further delegated at the President’s discretion, unless the Board specifically limits the President’s delegation of authority • Eliminates the detailed Self-Assessment Format to provide Board with greater flexibility and latitude when conducting Presidential evaluation

  9. Draft Proposed BORP Amendments • Chapter 4, Planning (Lead: L. Johnsrud) • Updates environmental context statement and mission of community colleges.

  10. Draft Proposed BORP Amendments • Chapter 5, Academic (Lead: L. Johnsrud) • Sections relating to research are being moved to proposed new Chapter 12 • Defines length of provisional status; provides for extensions of provisional status; allows President to terminate programs not extended or without established status application; allows the President to terminate BOR approved programs • Clarifies that a person may receive only one award in teaching and one award in research in their period of service at UH; and provides that campuses to develop selection procedures • Converts affiliation and cooperating agencies reports to upon request status; and eliminates section on Western Governors University, as UH is no longer participating • Broadens definition of semester from a defined 15 weeks to period that is consistent with student achievement and accreditation standards.

Draft Proposed BORP Amendments • Chapter 5, Academic – Continued • Allows reports on centers to be made upon request • Deletes requirements on establishing a theme • Revises nonresident campus ceiling at baccalaureate institutions to 35% for undergraduate students • Deletes credit by examination section; deletes details related to the library with conversion to executive policy and provides that the President may delegate to Chancellors; and deletes appendixes on General Education and Library Fees with conversion to executive policy

Lee) • General clean-up and streamlining of policies and/or statements which are duplicative or contradictory • Moves BOR-approved fees to the end of the chapter attachment and delegates authority for future adjustments to the President • Removes specific types of institutional financial aid in conjunction with new executive policy; retains the overarching philosophy of the Financial Assistance Policy, UH Regents & Presidential Scholarship, and State of Hawai‘i B Plus Scholarship

Lee) • General clean-up and streamlining of policies and/or statements which are duplicative or contradictory • Removes specific operational guidelines on student housing for campuses while retaining overarching policy statements on housing remains, along with assignment priority statements • Delegates student housing room rates to the President or President’s designee • Removes the Short-Term Student Loan Program • Revised International Student Health Insurance • Removes Articles/Addenda: UHM Campus Center Charter from 1971, UHH Student Housing Rates from 2005, Maui College Student Housing Rates from 2005

  14. Draft Proposed BORP Amendments • Chapter 8, Business & Finance (Lead: H. Todo) • Increases maximum dollar level of construction projects and consulting contracts beyond which Board approval is required • Makes other revisions to eliminate impractical and overly restrictive, prescriptive or cumbersome, or unnecessary procedures which are not required or are inconsistent with policy statements

Hashimoto (Non-Academic) • Authorizes the President to appoint faculty; provides that faculty compensation shall be in accordance with current collective bargaining agreement; and provides that the President shall promulgate policies in consultation with University executives setting forth the duties, responsibilities, qualifications, guidelines and timelines for selection, conditions for appointment, compensation and other administrative requirements: Department Chairs, Special Program Directors and Chairs of Academic Subdivisions, Graduate Assistants, Lecturers, and Cooperating Teachers/Counselors and Observation/Participation Teachers. • Continues Board support of exchanges of University of Hawai‘i faculty with other institutions and provides that the President shall promulgate policies for faculty exchanges

Draft Proposed BORP Amendments • Chapter 9, Personnel – Continued • Eliminates the requirement for the President to provide an annual report to the Board regarding special salary adjustments. • Delegates authority to the President to promulgate implementing policy to administer a faculty classification plan and make amendments to the plan, provided that any new faculty categories or permissible campus faculty groups shall be subject to prior approval of the Board • University of Hawai‘i at Mānoa faculty classifications to include seven (existing) categories with grades within each category: Instruction; Researcher; Specialist; Librarian; Extension Agent; Graduate Teaching Assistant; Lecturer • Provides that the President shall adopt policies relating to Clinical titles for non-compensated faculty appointments in Health Science and Social Welfare

Draft Proposed BORP Amendments • Chapter 9, Personnel - Continued • Extends political activity policy to employees seeking non-partisan public office (e.g. Mayor of the City and County of Honolulu, City Prosecutor) • Deletes radiational safety that is subject to other policies, procedures, rules and regulations • Provides that the President shall adopt rules applicable to the Waahila faculty housing and a University Housing Assistance Program • Provides that faculty sick leave shall be in accordance with the provisions of the most current collective bargaining agreement • Deletes obsolete policy relating to prohibition of service beyond age 70 • Updates the name of the agency responsible for administering the health benefit program

Draft Proposed BORP Amendments • Chapter 9, Personnel - Continued • University of Hawai‘i Hilo and University of Hawai‘i West O‘ahu faculty classification to include three (existing) categories with grades in each category: Instruction; Lecturers; Affiliate Faculty • Community College and Maui College Classification to include one (existing) categories with grades within each category: Instruction • Delegates to the President authority to identify high demand academic disciplines and recruit faculty in the recognized high demand disciplines at salaries that exceed the maximum of the appropriate salary schedule • Delegates to the President authority to establish, amend, and administer a classification and compensation plan for graduate assistants • Clarify the approving authority for legal representation requests • Delete obsolete reference to managerial personnel • List authority delegated by the Board to the President for certain Personnel Actions.

Draft Proposed BORP Amendments Chapter 9, Personnel - Continued • Updates section to reflect changes in the IRS regulations and to delegates authority to the President to make program changes as necessary • Amends to include feminine form “Emerita” of “Emeritus” • Deletes Incentive Early Retirement program which is inconsistent with of Act 179, SLH 2010 • Recommends 1) eliminating the requirement for the President to report executive salary exceptions as such are publicly posted; 2) amending various provisions to reflect the Board’s delegation to President; and 3) delegate to the President authority to approve amendments to the executive salary schedule • Allows executives personnel to request a leave of absence for family leave purposes based on provisions aligned with faculty and staff

Minaai) • Delegates to the President authority to add or delete from the exempt classes of action as operational needs change • Delegates to the President authority to establish child care programs and develop program guidelines • Delegates to the President authority to promulgate policies and procedures for the parking and operation of motor vehicles on University campuses

Gaines) • Allows individual investigators to choose whether or not to participate in projects for which the sponsor may impose certain limitations on dissemination • Deletes classified managerial group • Provides that classified research should not be conducted on campus • Provides that the President and Facility Security Officer shall possess a personnel security clearance and that security officer shall be responsible to ensure safeguarding classified information. • Precludes members of the Board of Regents and the administration without security clearance from accessing classified information

Gaines) cont. • Deletes rules relating to outside research projects • Deletes prohibition against outside use of University facilities • Deletes requirement that university substantiate basis for service ordering to RCUH • Increase purchase limits from $100,000 to $300,000 • Deletes requirement for monthly service order reports to the BOR • Amends requirement for annually executed agreement to annually review agreement
