Pine Hills NID County code requires factual determinations that proposed area is affected by: • Proliferation of crime; and • At least 3 of the following: • Traffic flow strangled by outmoded street patterns • Unsuitable topography or faulty lot layouts • Fragmentation of land uses/parking areas necessitating frequent automobile movement • Lack of separation of pedestrian areas from automobile traffic • Lack of separation of vehicle traffic lanes and railroad traffic • Excessive noise levels from automobile traffic

  8. Pine Hills NID Fragmentation of land uses/parking areas necessitating frequent automobile movement • Mix of residential and professional office • Multiple curb cuts and access points • Isolated commercial areas • Underutilized properties • Vacant properties

  9. Pine Hills NID Lack of separation of pedestrian areas from automobile traffic • Great distance between cross walks • Few mid block pedestrian islands • Poor signalization • Speeding traffic • Inadequate and unsafe bus stops

Pine Hills NID • Powers of NID • Accept grants, gifts, and donations • Eligible for Crime Prevention Funds • Enter into contracts; sue and be sued • Acquire, own, convey, lease, construct property • Promote and advertise the NID • Improve streets, lighting, parks, streets, drainage, utilities and safe access to mass transit facilities

  12. Pine Hills NID Powers of NID • Replan, vacate streets, subject to concurrence of BCC • Annual assessment of up to $500 per parcel of land • for capital improvements and operating expenses • Subject to referendum approval • Ad valorem tax up to 2 mills after referendum

Pine Hills NID County code imposes very high standards for local government NID to levy either assessments or ad valorem taxes: • Unanimous vote of all members of BCC • Then approval by special referendum requirements • Notice of referendum from Supervisor of Elections by mail and by publication in newspaper • Mail –in ballots • Business NID: Approval by property owners representing more than 50% of assessed value of property in district
