WHY DID THE FOUNDERS WANT TO CHANGE THE ARTICLES • After the Declaration of Independence there was a need for a National Government • 1.Manage trade and resolve disputes between the states • 2.Unite the states in diplomatic and trade relations with other nations • 3. Help the states cooperate in their fight against the British.. • Perform all the activities of government (examples) • Some leaders had seen a need for a national government even before the Declaration to deal with foreign relations and economic and commercial problems (Ben Franklin Proposed a colonial government in 1754. Than in July 1775 he submitted a draft for the articles to the Second Continental Congress) • On June 7, 1776 Richard Henry Lee introduced two resolutions to the Congress one of them became the Articles of Confederation.

  2. WHAT PROBLEMS WERE ADDRESSED IN THE ARTICLES • There was two major problems that made it difficult for the Continental Congress and the states to accept the Articles of Confederation. • 1. The fear of creating a national government that was too strong. • 2. The fear that some states would have more power than others in a national government. • Why did Americans feel this way?

  3. WHAT WERE THE SOLUTIONS TO THE PROBLEMS • The solutions that the Continental Congress crafted to deal with the problems determined the set up of the national government under the Articles • 1. Create a weak national government with a central legislature and no executive or judicial branches. Restrict the authority of the central legislature by giving it little power over the states. • 2. Gave each state one vote in Congress regardless of population. On important matters it require 9 states to agree which prevented the small states from out voting the large states.

  4. WHAT WERE WEAKNESESS IN THE ARTICLES • The limitations of the Articles of Confederation and the difficulties that arose under them led to the development of our Constitution. • 1. The Confederation Congress could not tax only request that the state governments send money to support the cost of the national government. RESULT was the national government has to borrow most of the money to pay for the Revolution and had no way to pay the debt.

  5. WHAT WERE THE WEAKNESSES IN THE ARTICLES CONT. • 2. National government had no power over the state governments or its people. It could not force the states or its citizens to do anything. • A. Citizens could only be governed by the state governments so if the state governments or their citizens disobeyed a resolution, recommendation of the national government they had no way to make the states obey • B. The Articles clearly stated the states each kept its sovereignty, freedom and independence. • The national governments inability to make the state governments and its people live up to its treaties led to serious problems

Congress had the power to make agreements with foreign nations but it did not have the power to make the states live up to these agreements. • A. Citizens would import goods and than not pay off the debt result was foreign nations would not trade with the U.S. • B. The British realized how weak Congress was in controlling foreign trade it closed the West Indies to Americans result was Americans lost money

  7. WHAT WERE THE WEAKNESSES IN THE ARTICLES CONT. • 4. The national government could not prevent unfair competition among the states. Congress had no power to regulate trade among the states. The results some states taxed goods passing through to other states, preventing efficient and productive trade and killing the economy.

Treats to citizens’ right to property The state legislatures had factions that were able to form majorities that violated the rights of minorities and the common good. • They passed laws that benefited themselves 1. canceled debts 2. confiscated property 3. created inflationary paper money • People believed these problems were a result of to much democracy in the state governments that is majority rule, when the majority pursued its own selfish interests, was a form or tyranny • Representative government with majority rule did not adequately protect natural rights or the common good. • Government was being used by one group of people to deny the rights of others.
