  2. Have we got enough? • To cover depletion and pollution of: LAND WATER AIR And prepare for worst-case scenarios due to: EXTREME WEATHER EVENTS NATURAL DISASTERS IRS/PRRM/EDNP

What have we got? • List of Environment-Related Legislations under GMA • National Caves and Cave Resources Management and Protection Act of 2001; • Wildlife Resources Conservation and Protection Act of 2001; • Mt. Kanla-on Natural Park (MKNP) Act of 2001; • Philippine Plant Variety Protection Act of 2002; • Clean Water Act of 2004; • National Environmental Awareness and Education Act of 2008; • Climate Change Act of 2009; • Organic Agriculture Act of 2010; • Disaster Risk Reduction and Management Act of 2010; and, • Republic Act No. 10023, which authorized the issuance of free patents to zoned residential lands both in urban and rural areas.   4. What have we got? • List of Enacted Protected Areas under GMA • Mt. Apo in Davao • Central Cebu • Sagay Marine Reserve in Negros • Northern Sierra Madre • Mt. Kanla-on in Negros • Mt. Banahaw and San Cristobal in Quezon • Mimbilisan in Misamis Oriental • Mt. Malindang in Misamis Occidental • Mt. Hamiguitan Range in Davao Oriental • Tubbataha Reefs in Palawan IRS/PRRM/EDNP

What have we got? • List of Executive Orders under GMA >Executive Order No. 578, the national policy on biological diversity to protect, conserve and sustainably utilize biological diversity. >Executive Order No. 282, protection of the whale shark and mapping of the migratory pathways, mandatory rescue and intensified investigation and prosecution. >Executive order No. 533, in 2006, integrated costal management as a national strategy to ensure the sustainable development of the country's coastal and marine environment and resources. >EO establishing the ASEAN Centre for Biodiversity (ACB) in the Philippines in 2005, the first regional centre of its kind in the world. >Executive Order 270 and 270A, mining industry revitalization following the principle of sustainable development and the paradigm of responsible mining. Then we got SC’s continuing mandamus on Manila Bay clean-up, the Writ of Kalikasan and greening of the justice system under SC Chief Justice Puno’s watch IRS/PRRM/EDNP

What have we got before GMA? • Since environment entered our development map 40 years ago (UNCHE, Stockholm 1972) >Environmental acts under Marcos: environmental code, pollution control, etc. >Under Cory Aquino: 1987 Constitution, NIPAS Act, Montreal Protocol, etc >Under Ramos: sustainable development (PCSD, PA21, etc.) >Under Erap: Ecological Solid Waste Management Act, etc) IRS/PRRM/EDNP

Where do we stand now? • After almost four decades: • Forestland down from 15.7 M has (52.6% of our total land area in 1934 to about 6.5 M has by 2003; continuing biodiversity decline • Dramatic changes in land use patterns • Water and air pollution though, somewhat arrested, continues IRS/PRRM/EDNP

  9. Where do we stand now?(INC 1999 v. SNC 2010 less LUCF) • Total (non-LUCF) increased 81% • Energy: 39% • Industry: 19% • Agriculture: 12% • Waste: 64% IRS/PRRM/EDNP

  10. Why such outcomes? • Too much legislation, not enough implementation? • Unfunded (or poorly funded) mandates? • Corruption? • Not enough environmental education, low public awareness? • Civic inertia, public apathy? • Poverty & inequality? • Population? Carrying capacity? IRS/PRRM/EDNP

Do we need more laws? • Effective implementation of existing policies and legislation • Budgeting as indicator of intent and will • People’s participation • Major policy gaps: >new policies/legislations---land use, population, freedom of information, SFM, etc. >policy reconciliation/coherence---CARP, NIPAS, IPRA, Mining Act, AFMA, etc. IRS/PRRM/EDNP

  12. To conclude… • No way around policies and legislation as every public spending needs to be so justified. • We need to make good at what’s already in place. • If the problem is more mindset and behavior, then the solution would be less regulation and more EDUCATION. IRS/PRRM/EDNP
