The Mission of the Bureau of Land • Ensure that hazardous and non-hazardous wastes are managed in an environmentally sound manner; • Encourage the recycling and recovery of waste materials through suitable incentive/disincentive efforts; • Provide remedial responses and/or provide oversight to the uncontrolled releases of hazardous and petroleum substances into the environment.

ILLINOIS ENVIRONMENTAL PROTECTION ACT • Prohibitions of the “Act” • NO open dumping of C&D waste • NO open burning of C&D waste
MANAGEMENT OF GENERAL C&D DEBRIS • Landfill • Transfer Station • C&D Transfer, Storage or Treatment Facility (operated pursuant to 22.38 of the Act) • Recycling Center (not regulated by IEPA)
C&D Recycling 415 ILCS 5/22.38 Facilities accepting exclusively C&D for Transportation, Storage or Treatment 22.38 sites must comply with local Zoning In the absence of zoning – 1300 ft. from a residence
Operating Requirements • Within 48 hours sort/separate material that can be recycled from the waste that must be disposed • Within 72 hours transport off site all non-recyclable wastes • Limit non-recyclables to 25% -- wood recovered for the secondary fuel market counts toward the 75%
Operating Requirements • Non-putrescibles can accumulate for 6 months • Putrescibles items must move off site in 45 days • Keep Records to demonstrate compliance and identify the generator and transporter • CONTROL – odors, noise, vectors, dust, litter, access • Take precautions against fire
Operating Requirements • Storm water runoff must be controlled • Leachate properly managed • ASBESTOS – comply with all applicable laws • NOTIFY – the Illinois EPA • If operations commence after 8-24-2009 you must obtain and Illinois EPA issued permit prior to commencing operations [ILCS 5/21(d)]
Local Siting Requirements • ILCS 5/3.330 Pollution Control Facility Definition -- Any waste storage site, waste transfer station, waste treatment facility • ILCS 5/39.2 The county Board or governing body shall approve or disapprove requests for local siting for each pollution control facility
ILCS 5/22.15 Solid Waste Management Fund • $2.00/ton collected at the landfill • A unit of local government can collect $1.27/ton • However ILCS 5/22.15(k) exempts the SWMF fees from recyclers (22.38 sites) provided 50% of the waste received is reusable • Processors must have written approval from the Illinois EPA
ILCS 5/22.44 Subtitle D Management Fund • $0.22/ton collected at the landfill • However ILCS 5/22.44(c) exempts the SDMF fees from recyclers (22.38 sites) provided 50% of the waste received is reusable • Processors must have written approval from the Illinois EPA
Management of CCDD • Section 3.160 of the Act (2005 & 2007 amendments) • Uncontaminated concrete with protruding rebar and reclaimed asphalt pavement is NOT “waste” if separated or processed and returned to the economic mainstream within 4 years • 25% removed each year
