Powers of the Board • Contract with cities and counties to operate local sub-systems • Responsibility to establish interoperability standards • Apply for and hold licenses for regional and local sub-systems • Adopt regional performance and technical standards • Enter into any contract necessary to carry out responsibilities
Powers of the Board • Acquire and dispose of property • Contract with State for regional and local enhancements • Apply for and administer grants • Determine sub-regions for distribution of costs • Provide for user fees for administrative, operational and capital expenses • All other powers provided for Joint Powers entities in Minnesota Statute Section 471.59
Requirements for Participation • County within or adjacent to Phase 3 with commitment to regional planning and planned, authorized or developed local enhancements or integration of dispatch facilities into a cooperative communications system • City within or adjacent to Phase 3 with commitment to regional planning and planned, authorized or developed a local sub-system
Members of the Board • County Commissioner from each county party to the Agreement • City Council member from each city party to the Agreement • Representative from the Regional Advisory Committee • Representative from the Regional User Committee • Representative from the Regional Owners and Operators Committee

Appointment and Term • Must be appointed by governing body • Term is for one year AND until successor appointed • No limit on number of terms a member may serve • Successor must be appointed within 60 days of expiration of term as elected official • Alternates may be appointed by governing body
Application process for participation • Initial group prior to convening Board derived from RAC membership • The Board will establish policies and procedures for application for participation • Any City or County meeting the criteria for participation may request membership in accordance with policies and procedures adopted by the Board
Officers of the Board • At the initial meeting and annually thereafter, the Board shall select: • Chairperson • Vice-Chairperson • Recording Secretary • The Recording Secretary is not required to be a Board Member
Board Meetings • Must meet at least annually before June 30th • Board shall establish a meeting schedule appropriate to the workload • Board shall provide a process for special meetings • Board shall designate meeting location • Board shall adopt rules, policies and procedures for the conduct of meetings
Administrative Services • Board shall establish policies and procedures for administration of affairs • City of St. Cloud shall provide all administrative services • Board shall provide a policy for the reimbursement of administrative expenses “in a fair and equitable manner reflective of the extent of participation and use of services”
Categories of Expenses • Administrative: Expenses associated with the administration of the Board • Operational: Expenses associated with the continued operation and maintenance of local and regional enhancements • Capital: Expenses associated with acquisition of goods and services related to providing enhancement infrastructure
Budget Process: Rules • Local and sub-regional Costs • Capital and operational costs for local enhancements benefiting one political sub-division or a sub-region are the responsibility of that sub-division or sub-region • Capital costs for local enhancements must be approved by that political subdivision before inclusion in a final budget • Capital Costs for sub-regional enhancements must be approved by all political sub-divisions in the defined sub-region before inclusion in a final budget • The Board may define sub-regions as necessary
Budget Process • Board must adopt budget prior to June 1st • Budget submitted to all parties to Agreement for review • Each party must respond with approval or objection by July 1st • The budget shall be deemed approved in the absence of action by August 1st • Board shall take final action approving budget not later than August 15th
Other Provisions • Withdrawal requires payment of all obligations and one years notice. Requires majority vote of full membership of governing body. • Termination requires adoption of resolutions by 75% of the governing bodies party to agreement • Modifications require approval of all governing bodies party to the agreement
