Growth Management & Schoolsduring 2005 • Volusia County Council adopts new school impact fee. • School Board of Volusia County adopts School Board Policy 613. • Volusia County Smart Growth Implementation Committee makes recommendations to local governments that include schools. (Charter Recommendation #2) • Florida Legislature amends its 1985 Growth Management Act with the adoption of SB 360 requiring school concurrency.

School Board Policy 613 • Requests local government consider the impact of increasing residential densities on school capacity. • If approval of the proposed rezoning and/or land use map amendment would result in the student population exceeding existing and planned school capacity, the School Board believes the local government should publicly acknowledge that approval of the proposal will have an adverse impact on the educational services and facilities provided in the area. • School Board expects local governments to require applicants to provide the school district with the means to mitigate the adverse impact on area schools.

Since Smart Growth Recommendations • Participated in the review, evaluation and public hearings of land use map amendments and/or rezonings that increase residential densities; • Negotiated mitigation in the form of: • Upfront, lump sum payment of school impact fees without protest • Fair share of increased land cost for site acquisition (not a credit to impact fee) • Payment of off-site infrastructure (not a credit to impact fee) • Reserved future school sites as part of master plan developments
Since Smart Growth Recommendations • Established a school district development review committee which meets Thursdays to review development projects with applicants; • Formed a technical committee of city, county, and school district planners for the purpose of developing a unified public schools facilities element. Funding obtained from most cities, the county and school district for the purpose of hiring one consultant.
Proposed Amendment No. __(School Capacity)May 22, 2006 Draft • The proposed amendment, in full, shall read as follows: The Volusia County Home Rule Charter, Chapter 70-966, Laws of Florida (Sp. Acts), as previously amended, shall be further amended in pertinent part as follows: • Article II, Section 202.5 is hereby created to read as follows: • Sec. 202.x. School Capacity. No county or municipal comprehensive plan amendment or rezoning which allows for increased residential density shall be effective unless the school district: 1) certifies sufficient or available student capacity; or 2) enters into a mitigation agreement to provide additional student capacity, if required. The county council shall implement this section by ordinance which shall prevail over conflicting municipal comprehensive plan, ordinance or resolution provisions no later than June 2007.
Proposed Changes to the Volusia County Charter • The School Board shall be a voting member of the Growth Management Commission or any such replacement Commission and its vote shall be equal to all other voting members.
Educated Growth • The School Board believes that schools are an essential component of successful communities. We are investing available capital dollars in constructing new capacity and revitalizing older schools. Vibrant communities require the provision of a quality educational environment for residents of all ages.
