Form I-9 • To be completed for all new employees after offer of employment accepted. • May be completed before starting work • Section 1 must be completed by end of 1st day of work • Section 2 must be completed by end of 3rd day of work • Social Security Number now required per E-Verify rules
Verify • Department of Homeland Security (DHS) electronic system used to verify eligibility to work • Now required for all new employees • Three possible results: • Confirmed eligible to work • Determination of not eligible to work • Tentative Non-Confirmation (TNC)
The TNC Process • Employee decides to contest or not • If do not contest, terminate employment • If contest, refer to DHS for a final determination • Note: Employment protected during period under review by DHS • Results: • Confirmed eligible to work • Final determination, not eligible and terminated • No appeal of DHS decision or termination within IU
IU’s use of HireRight’s I-9/ E-Verify Solutions • Electronic Form I-9 • Employee completes Section 1 within time limits • Hiring department completes Section 2 within time limits • Completed Form I-9 feeds automatically into E-Verify • E-Verify results received immediately • If Form I-9 completed early, system holds submission to E-Verify until first day of work
The TNC Process at IU • If E-Verify response is a TNC • Hiring department refers employee to UHRS • Hiring department informs UHRS • Hiring department takes no further action in system until case is closed • UHRS meets with employee • If employee does not contest, employment terminated, DHS informed, case closed • If employee contests, referred to DHS for a review and final decision • Employment protected during this period
TNC Results • Eligibility confirmed, UHRS informs hiring department & employee, closes case • Eligibility denied, UHRS informs hiring department & employee, employment terminated, DHS informed & case closed
Miscellaneous Points • IU Reference Number • Cases of no Social Security Number • Process for employees who need assistance in completing Form I-9 • Use of paper Form I-9 and uploading to HireRight • Process for new employees who do not have access to an IU campus
