Thepenalpoliticsofthe Slovak Republic • The SR delares by its penal politics the level of protection of the basic human rights and freedoms. • The penal politics of the Slovak Republic is based on the traditional continental penal process and on relatively rigid substantive and procedural legal rules. • The penal politics of the state is specified especially in its penal legislation, substantive and procedural system, organization of its bodies and institutions providing the enforcement of the criminal norms as well as in the practical activities of these entities.
Thesourcesofthecriminallaw • The Constitution of the Slovak Republik • The Law No 300/2005 Criminal Law This law deals with the basics of criminal responsibility, kinds of punishments, kinds of protective measures, their imposition and the bodies of the criminal acts. • The Law No 301/2005 Code of Criminal Procedure The Code of Criminal Procedure deals with the procedures of the law enforcement authorities and the courts so that the criminal acts be properly investigated and their perpetrators lawfully punished in accordance with the basic rights and freedoms of physical and legal entities.
Thescopeofpowersofthe Body ofPrison and JusticeGuards The Body of the Prison and Justice Guards is an armed safety body which secures the execution of imprisonment and remand and the penitentiary care for convicts serving their prison sentence. 19 budgetary organisation 1 General Directorate (as the governing, methodical and controlling body) + 18 remand centers and prisons
Theplacesofimprisonment 1) Prisons: • With minimal degree of guarding, • With medium degree of guarding, • Wiht maximum degree of guarding, 2) Youth prison 3) Remand centers and the hospital for the accused and the convicts
Prisonswithminimaldegreeofguarding a) The accommodation facilities for convicts are unlocked from reveille until bedtime; b) The convicts are allowed to move freely in the delimited areas of the institution, c) The convicts are engaged in work in workplaces outside of the institution, d) The convicts can be allowed to move freely outside of the institution if necessary for the performance of work done for the institution.
Prisonswithmediumdegreeofguarding a) The convicts are locked in the accommodation facilities, but not in their cells or rooms; b) The convicts move outside of the accommodation facilities under the supervision of a prison guard, c) The convicts are engaged in work in workplaces inside or outside of the institution, d) The convicts are not allowed to move freely outside of the institution.
Prisonwith maximum degreeofguarding a) The cells, accommodation facilities and rooms are locked, b) The convicts move outside of the cells and the accommodation facilities under the supervision of a prison guard, c) The convicts are engaged in work only in workplaces inside the institution or work in cells or rooms, d) The visits of the convicts are done without direct contact.
Specialcategoriesofconvicts • minors, • women, • foreigners and persons without nationality in case of whom special attention is paid to their psychical, physiological, age, ethnic and national specificities.

Theeducationalpossibilitiesoftheconvicts • Obligatory school attendance, • Secondary vocational school, • Individual education, • Grammar school, • Educational courses, • Training courses, • In the year 2014, 438 convicts were engaged in the educational process (4,33% from the average number 10 099).
Thecooperationoftheprisonswithnon-governmentalorganisations • In the field of education and edification of the convicts, • In the field of legal awareness, • In the field of effective communicatiion and acquisition of skills which the convicts can use after their release from prison, especially in trying to find a job at the labour market,
* Training courses (38 convicts): - gardener- cultivation of the greenery - 14 convicts, - PC skills - 15 convicts, - welder - 9 convicts. ** Other courses (135 convicts): - „Baber“ - 15 convicts, - „Work at heights“ - 16 convicts, - ,,Everyday legal awareness“ - 24 convicts, - „Asociation of legal clinics“ - 22 convicts, - Legal clinic for community- 14 convicts, - The basics of the English language- 6 convicts, - The course to complete elementary education - 38 convicts( out of whom 19 were minors).
The state ofeducatingconvicts • The sum total of illiterate persons, persons with incomplete elementary education and persons without secondary education accounts for – at least 50 % of the overall number of convicts. By December 31, 2014: • 195 illiterate persons (162 men, 30 women, 3 minors) • 761 persons with incomplete elementary education (692 men, 53 women, 16 minors) • 3394 persons with only elementary education (3109 men, 242 women, 43 minors)
The structure of convicts according to labour classification – around 50% of convicts entering prison do not have any work habits and the potential to find a job after release. By December 31, 2014: • 4 070 without labour qualification (3665 men, 343 women, 62 minors) • Out of whom1/3 convicts in prison are younger than 30 years of age (2817 persons, out of whom 116 are women)
Social-psychologicaltraining • 193 convicts attended this training in the year 2014 (1,91% out of the average number10 099), • Focus: - getting to know oneself, communication, management of conflicts, stress, assertivity, etc. • It is provided by the psychologists of the imprisonment department.
Expected state • All convicts released from prison – in the framework of preparation for relaease in the preparation for release departments – an elaborated action plan for the support of job-seeking at the labour market + course of financial literacy, • The attendance of training courses in lacking professions ( on the basis of personal interest), • The attendance of social-psychological trainings of larger number of convicts – strengthening of communicational skills, management of stress and manipulative behavior, etc.
