Continuing Amendment 25 • 3. When a president cannot perform his duties (having major surgery) • Has to send a letter to the House and Senate telling them he can’t perform his duties • Vice president then takes over • When he is ready to come back, he writes another letter to the House and Senate. • When a president WON’T take the time off, the Vice President and majority of cabinet write a letter and say that he can’t perform the duties. • If there’s a conflict/disagreement over whether he is fit to return or to leave, congress makes the vote (2/3rds needed).

Has to be for next term. • $400,000 is President’s salary • But a lot of perks! • 5. Oath of office: Chief Justice of supreme court holds bible for president to take the oath of what he’ll/she’ll do as president of our country. • January 20th
Powers of the President (pg 5 of outline)- Enforces Laws • 1. Legislative Powers • A. Can convene (call them to- urgent matters) special sessions of Congress • B. Can adjourn congress only when house and senate are arguing when to adjourn. • D. + E. Signs bills and Vetoes bills • Line item veto: looks through whole bill and if there’s something he doesn’t like, he can veto the one part and it becomes a bill.
II. Judicial Powers • A. Appoints judges to Supreme Court and all federal courts with the approval from the Senate. • All judges have been appointed by some president. • B. Grant reprieves (delay) and pardons (wiping away) for federal crimes but not an impeachment. • A gov. can do the same but just for state crimes • Federal crimes: robbing a federal bank, post office • Cannot pardon yourself • III. Executive Powers • A. Can send in troops /not send money. Enforce laws. (Little Rock Arkansas- Integration of Schools). • B. Ambassadors, cabinet, judges when appointed need 2/3 vote approval from Senate

Other Powers • A. Commander-In- Chief of the Armed Forces (No General can do what they want without consent or they will be fired) • McArthur and Truman, Roosevelt and Patton, dropping the A-Bomb, football briefcase (phone, decision making information, codes)

Emergency Powers-floods, disasters • Go to the area and declare it a disaster- might call out for example national guard to help people in the area. Congress might send money • C. Treaties • 1. Peace Time- Brings to Senate and needs a 2/3rds vote • Example: nuclear weapons treaties • 2. War Time- no consent is necessary • Example: See Berlin Wall handouts

Vietnam War • Used to be two separate (North and South) fighting each other • Gulf of Tonkin Resolution-1964 • U.S.S. Maddox- N. Vietnam attacks our ship • When Johnson hears- he asks congress to pass this resolution (not declare war) allowing him to handle the resolution • U.S. troops are sent to Vietnam and the draft begins • Daniel Elsberg • Got permission to do research in pentagon • Finds out U.S.S. Maddox did not happen and was a strategy to get us into the war
Other Powers Continued • IV. Other Powers • 1974 War Powers Law • A president must notify congress within 48 hours that he is sending US soldiers to a hostile country • Congress then has to approve it and will allow them to stay 90 days UNLESS congress would give another 90 days or declare war
