SUBDIVISION REVIEW • City of Cornwall has delegated subdivision approval. • Plan has been reviewed in respect of Section 51(47) of the Planning Act. This is typically used to review requests for minor changes to the Draft Plan Conditions such as lapse date extensions. • Planning is recommending a three year extension given that the previous owner did request a previous extension in 2010.
PLANNING ACT PROVISIONS • Planning Act, Section 51- Subsection (47) and (58): • Provisions are made for minor changes to Draft Plans, before final registration of the Registered Plan, with no need for Public Notice or full circulation to all agencies. • Planning Division finds this change to be minor and, therefore, does not warrant new approval/circulation as would a full redesign of the lot layout, for example.
SUBDIVISION REVIEW • Subdivision is located east of Pitt Street and south of Tollgate Road East • Proposal includes 14 single family lots,10 semi-detached lots, and 4 townhouse lots • Phase 1 has already been registered as 52M-18
RESIDENTIAL ZONING • As a result of the former Draft Plan in 2008, the zoning was changed from Commercial to Residential to address the multi-unit development. • In 2004, however, there had been a site specific zoning applied to the Maple Grove Subdivision which at one point included this area, then was removed to Highway Commercial and now is included as Blackburn.
RESIDENTIAL ZONING • This special zoning allowed semi lots on smaller lots with attached garages. • The Developer has utilized parts of this By-law (200-2004) zoning to re-design this subdivision to include semis, however, with the former Draft Plan only RES 20 was required. As result, a Housekeeping exercise will see the former site specific zoning back so as to recognize the lot frontages and requirement for garages.
