A transition phase • Most MS have implemented partially the Directives either in force or to be transposed • The technical rules used for vehicles Placing In Service (PIS) differs Difficulty to establish equivalence • Cross-Acceptance agreements settled between Member States (MSs)/National Safety Authorities (NSAs) apply EFRTC General Meeting
Some figures • With NSAs on the current state of play including figures on vehicles PIS (2004 to 2009) • Different processes Number of interfaces vary from 12 to 57 • Increase of the number of vehicles PIS (2004 to 2009) • Very low number of vehicles authorised per type EFRTC General Meeting
Identified issues • Need for better understanding of some Directive requirements: • Scope of authorisation • Extent of modification requiring a new PIS • Independence criteria of checking bodies • NSA involvement in the process • Vehicle type definition • Handling of grandfather rights EFRTC General Meeting
Identified issues • Management of the transition phase: • Consistent and workable national legal frameworks • Evolution of the existing cross-acceptance agreements • Practical issues: • Use of several languages for cross-border vehicles • Disparity of rules requires the applicant/manufacturer to adjust each time EFRTC General Meeting

Transposition of Directive 2008/57 • Deadline: 19/07/2010 • Not all MS will be in time but are working on • Better definition of the authorisation processes: • Subsystem & vehicle authorisation • Type authorisation • 1st authorisation • Additional authorisation • Cross-acceptance (XA) EFRTC General Meeting
Common understanding • Pre-requisite to avoid inconsistent implementations by the MS • Transparency of rules necessary for all actors • First version of the Reference Document end 2010 • Second version mid-2011 • Current XA agreements will evolve towards the reference document EFRTC General Meeting

Within ~ 3 to 5 years Annex C specifies requirements for OTM both Self propelling and hauled vehicles Entry into force of LOC PASS TSI Non-mandatory until the next revision of the LOC PASS TSI EFRTC General Meeting
