HSP Contract Shell GOV 21.61/TAC 20.115 require the agency to list subcontracting opportunities that are "probable" for the Respondent to use as a guide.

Texas Administrative Code §20.14 • 3 Methods for Determining • Good Faith Effort Compliance • GFE Method 1 (Solicitation): • (Attachment B) • §20.14(d)(1)(C) • - Provide notice of subcontracting opportunity to minority or women trade organizations or development centers (two or more) no less than seven (7) working days prior to submission of the response to the contracting agency. • §20.14(d)(1)(D)(i) • - Notify at least three (3) HUB businesses of the subcontracting opportunity, allowing them no less than seven (7) working days prior to respond.
Texas Administrative Code §20.14 • GFE Method 2 (All HUBs): • (Attachment A) • §20.14(d)(1)(D)(ii) • - Submit documentation that 100% of all available subcontracting opportunities will be performed by one or more HUBs. • GFE Method 3 (Meeting/Exceeding Goal): • (Attachment A) • §20.14(d)(1)(D)(iii) • - Submit documentation that one or more HUB subcontractors will be utilized and that the total value of those subcontracts will meet or exceed the statewide goal for the appropriate contract category found in §20.13(b) of this title, or the agency-specific goal for the contracting category established by the procuring agency, whichever is higher. When submitting GFE Method 3 you can subcontract portion of the contract to Non-HUBs and active HUBs. However, you can only useactive HUBs that do not have a continuous contract in place with the Respondent for more than 5 years will meet/exceed the HUB Goal.

Submit copies of all Active HUB Vendors CMBL (“HUB Status” page only) - Place these copies right after each Subcontracting Opportunity

TCEQ HUB Program Outreach - Mentor – Protégé (M-P) Program: • Advantages of being a mentor in a M-P program • Utilizing protégé in HSP for a bid of any state agencies and/or universities for subcontracting counts as your good faith effort requirement and does not require contractor to perform additional solicitation for subcontracting protégé is providing • TAC 20.14 • Your company is listed in the Mentor –Protégé Agreement database on CPA’s website for all state agencies and universities to utilize for outreach
