BACKGROUND • Nov. 5, 2013 – BCC Denied OCPS’s Special • Application for Relief High School • in West Orange County • Dec. 2013 - As a result, School Board filed • Two Court Cases Against Orange • County, • Initiated 3-Step Intergovern- mental Conflict Resolution • Process Under Ch. 164, • Fla. Stat., and • Abated Court Cases until May 1st 2
BACKGROUND Three-Step Intergovernmental Conflict Resolution Process under Ch. 164 1. Initial Conflict Assessment Meeting – Feb. 4th 2. Joint Public Meeting – Feb. 18th 3. Mediation – April 1st and 7th Mediated Settlement Agreement Executed by Parties’ Representatives on April 7th 3
Mediated Settlement Agreement Key Additional Conditions and Restrictions Offered in Settlement Agreement by School Board on its Application: – Football Stadium Located Off Site at County Park on Ficquette Rd. – Architectural Style of H.S. Substantially Similar to Sun Ridge Middle School – Enhanced Tree Canopy Buffer – 8 Foot High Wall 4
Mediated Settlement Agreement • OCPS is not Required to Accept any other Conditions or Restrictions on its Application • OCPS also Consents to Amendments to County’s • Comprehensive Plan and School Siting • Ordinance Prohibiting Any Other High Schools • in Rural Settlements • ● Parties Agree to Work to Develop a Policy • on OCPS’s Purchase of Land for Future School • Sites 5
Mediated Settlement Agreement Approval of Settlement Agreement By Both Parties Today will Require BZA and BCC Public Hearings on OCPS’s Application with Additional Conditions and Restrictions • Decision by BCC to Approve Settlement Agreement is Not a Decision to Approve OCPS’s Application at the Subsequent Public Hearing 6
