  3. What is a Title V Permit • A Federal Operating Permit (FOP) • Issued by TCEQ and legally enforceable • Lists all applicable requirements

  4. ApplicabilityWhen is an FOP required for GHG? If the Potential to Emit (PTE) exceeds: 100 tpy GHG and 100,000 tpy CO2e • GHG aggregate group • CO2e = GHG times GWP

  5. What is a site? • Total of all stationary sources • Contiguous or Adjacent Properties • Common control • Less than ¼ mile apart

  6. PTE Certification • APD-CERT can certify GHG and/or CO2e • May be used to certify that a site is not a major source • Federally Enforceable limits • Submit before time required for FOP application

  7. When is the FOP application required for GHG? • PSD • Application before operation for new FOP’s • ASAP for existing FOP’s • Can’t operate before Issuance of revised FOP • No PSD and New FOP (GHG only) • One year after EPA’s approval of rule

  9. GOP vs. SOP • General requirements • De minimis, standard permits, & PBRs only • No Public notice/EPA review for ATO • Site specific review • Compliance plans allowed • Public notice/ EPA review for each site • FOPs • Renewed every 5 years • Legislative notification
