  1. Transition Services • The IEP must include: 1) For each student with a disability beginning at age 14 (or younger if deemed appropriate by the IEP team) and updated annually, a statement of the transition service needs of the student under the applicable components of the student’s IEP that focuses on the student’s courses of study (such as placement in advanced placement courses or a vocational education program.

  2. Transition Services cont... 2) For each student beginning at the age of 16 (or younger if deemed appropriate by the IEP team), a statement of needed transition services for the student including, if appropriate, a statement of the interagency responsibilities or any needed linkages.

  3. Transfer of Rights • Beginning at least one year before the student reaches the age of majority under State law, the student’s IEP must include a statement that the student has been informed of his or her rights under Part B of the Act, if any, that will transfer to the student on reaching the age of majority.

  5. 300.345 Parent Participation and Notice of Meeting (If the student is age 14, or younger if deemed appropriate by the IEP team, or if transition services are requested or recommended): Did the student file contain documentation that the notice of the IEP meeting indicated that a purpose of the meeting would be the development of a statement of the transition service needs of the student and was the student invited?

  6. If the student is age 16: Did the student file contain documentation that the notice of the IEP meeting indicated that a purpose of the meeting would be the consideration of needed transition for the student?

  7. If the student is 16: Were other agency representatives identified and invited?

  8. 300.347 IEP Checklist(b) Transition Services • Does the student’s IEP (if age 14 or younger if deemed appropriate by the IEP team) contain the requirements as stated in the Federal regulations including transition services (Age 14-appropriate instruction), (Age 16-related services, community experience, and post-school objectives) if appropriate.

(c) Transfer of Rightsincluding 6.31.2.13 K • When a student with a disability reaches age 18 in NM and does not have a court-appointed guardian, all rights accorded to parents under IDEA-B transfer to the student and the parents have only the right to receive copies of required notices to the adult student. The schools must discuss this change with parents and students as part of the normal transition planning beginning no later than age 16. Beginning no later than age 17, the student IEP must include a statement to the effect that the parent and the student have been informed of the rights that will transfer at age 18.

  10. 6.31.2.11 G NMACGraduation Planning and Post-Secondary Transition • Does the student IEP contain a program of study indicating which Pathway (Standard, Career Readiness, or Ability) the student will use to receive their diploma?

  11. 6.3.2.9.18.9.8 NMAC • Does the student file contain annual documentation that all options to the awarding of the diploma were considered in the following order of options (Standard, Career Readiness, or Ability) and does the student IEP contain current graduation plans?

  12. 6.3.2.9.18.9.5 NMAC • Was the exit IEP meeting held to review whether all requirements under the final IEP were met, and graduation plans were accepted?
