Fair Use Policy • A FUP shouldenablethe roaming provider to preventabusiveoranomaloususage • Provider shallprovideregulated roaming retail servicesatthedomesticprice to its roaming customerswho are normally residentorhavestablelinksentailing a frequent and substantial presence in theprovider´s MS • Otherelementsof a FUP are: • themeasures to stop organisedresaleof SIM cards and • limitsfor open bundles and pre-paidsubscription
Fair Use Policy • A documentaryproofmayberequestedbeforeorafterconclusionof a contract • Thebestpracticeforexistingcustomers prior to 15 June 2017 wouldbe to switchthemautomatically to the RLAH tariffscheme • From 15 June 2017, anyrequestofproofofnormal residence orstablelinksafterconclusionof a givencontractshouldbe limited to circumstances in whichbilling data appear to provideindicationsofabusiveoranomaloususageunrelated to periodictravel • If a customercannotsupplytherequiredstablelinksor permanent residence documentation, theoperatordoes not have to offer RLAH to thatcustomer but wouldinsteadbeable to surcharge any further roaming activity
Controlmechanism and objectiveindicators • To preventabusiveoranomaloususagebeyondperiodictravelling roaming providersmayapply fair, reasonable and proportionatecontrolbased on objectiveindicators. • Twotypesofobjectiveindicators:
Prevailingdomesticconsumption and presence • A roaming provider maytakemeasures to establishwhether a customer has prevailingdomesticconsumptionorprevailingdomestic presence • These indicatorsshouldbeobservedcumulativelyfor a period ofat least 4 months • Eitherprevailingdomesticconsumptionorprevailingdomestic presence ofthe roaming customeris a proofof non-abusive and non-anomaloususage • If prevalence ofboth roaming presence and consumption (despite evidence of residence orotherstablelinks), operator´salertfollowswarningaboutthe risk oftriggering roaming surcharges • A customerisgiven a period ofat least 2 weeks to changeusagepatterns • Ifusagepatterns do not change, operatormayapplysurcharges to further roaming services
Otherobjectiveindicators • Long inactivityof a given SIM cardassociatedwith use mostlywhile roaming • BEREC considersitgoodpractice to monitor usageover a fourmonth period • Subscription and sequential use ofmultiple SIM cards by thesamecustomerwhile roaming • Thisindicatoris not subjectofanyobservation period • Again: • A customerisgiven a period ofat least 2 weeks to changeusagepatterns • Ifusagepatterns do not change, operatormayapplysurcharges to further roaming services
Organisedresale • The roaming provider maytakeimmediateproportionatemeasures in case oforganizedresale • Organisedresaleoccurswhen a numberof SIM cardshavebeentheobjectoforganisedresale to persons not effectivelyresidingorhavingstablelinks in the MS ofthat retail roaming provider forotherpurposesthanperiodictravel • These measurescanbeatwholesaleor retail levelaccording to theviolationofcontractconditionsthat has beenevidenced
FUP for open data bundles • Open data bundlemaybe: • Unlimited data tariffs • Tariffswheretheimplicitdomestic unit pricefor data islowerthantheregulated maximum wholesale cap ( ) • Bundleprice – isthefixedperiodicfeepayableforthe mobile retail servicesincluded in thetariffplan (not only data services but alsovoice and SMS), excl. fixed ECS and non-mobile services (mobile handsetsubsidy, newsservicesetc.) • Roaming data allowancecalculation: ()*2
FUP for open data bundles • Twooptions: • Roaming data allowance > domestic data allowance • 1. up to thedomestic data allowance – domestic retail price • 2. up to the roaming data allowance – domesticout-of-bundleprice • 3. abovethe roaming data allowance – domesticout-of-bunleprice + surcharge • Roaming data allowance < domestic data allowance • 1. up to the roaming data allowance – domestic retail price • 2. up to thedomestic data allowance – domestic retail price + surcharge • 3. abovethedomestic data allowance – domesticout-of-bunleprice + surcharge
FUP forpre-paidtariffs • A pre-paidtariffplanmeans a tariffplanunderwhich mobile retail services are povidedupondeductionofcredit made available by thecustomer to the provider on a per-unit basis • As alternative to requestingproofofnormal residence orotherstablelinks roaming providersmay limit theconsumptionof data roaming services by applyingthisformula:
Applicationof a surcharge • Surchargesshallmeettherequirements: • Thelevelofsurchargesshall not exceedthe maximum wholesalecaps • The sum ofthedomestic retail price and anysurchargeappliedforregulated roaming servicesshall not exceedthe retail roaming pricecaps, in case of roaming callsreceivedformed by theweightedaverageof MTR in the EU • Retail roaming pricecaps do no applywhen no surchargeisapplied (domesticpricemaybehigherthanthe retail roaming price cap)
Alternativetariffs • Alternativetariffs are tariffsforregulated roaming servicesthatcanbeoffered in addition to theregulatedtariffs (e.g. per diemtariffs) • Customerswhoexplicitlydecide to optforanalternativetariff has to beinformedaboutthenatureofthe roaming advantageswhichwouldbetherebybelost – thisinformationmustbe on a regularbasis (app. once in 12 month period) • Switch to RLAH regimeisautomaticforallcustomersexceptforthosewhohavedeliberatelychosen to stay on alternativetariffs • Switching has to be made free ofcharge, withinoneworkingday
Tariffswithout roaming services • Roaming Regulationdoes not obligeoperators to offer roaming services in theirtariffplans • Switchingbetweentariffswithorwithout roaming servicesshouldfollowthesameprocedures as switchingbetweenotherordinarytariffs in the MS • Onlythecustomershouldinitiatetheswitching and shouldgiveactiveconsent prior to anyswitchingtaking place • Mechanismsforsimple and quickswitchingbetweentariffswithorwithout roaming should not beused to circumventtheRegulation
