EPA FY 2006 Compliance and Enforcement Annual Results • Enforcement actions are projected to reduce pollution by 890 million pounds, EPA’s fourth highest year. • Defendants will invest $4.9 billion to reduce pollution and achieve compliance, EPA’s second highest year. • Over the past three years, EPA has reduced almost 3 billion pounds of pollution and required companies to invest almost $20 billion in pollution control equipment. • Approximately 74% of pollution reductions and 71% of pollution control investments focus on priority air and water pollution problems. • Responsible parties will clean up 1.3 billion cubic yards of contaminated water and 15 million cubic yards of contaminated soil.

  4. EPA’s compliance and enforcement program focuses on key environmental risks and noncompliance problems. Selection Criteria for National Enforcement Priorities EPA’s Office of Enforcement and Compliance Assurance evaluated potential priorities using three criteria: • Significant Environmental Benefit: can significant environmental benefits be gained, or risks to human health or the environment be reduced, through focused EPA action? • Pattern of Noncompliance: are there identifiable patterns of noncompliance among specific regulated entities, sectors, geographic areas, or within environmental statutes or programs? • Appropriate EPA Responsibility: are the environmental or human health risks or the patterns of noncompliance sufficient in scope such that EPA is best suited to take action, or pursue a collaborative approach?

FY 2005-2007 National Enforcement Priorities • Multi-year priorities are used to address specific environmental problems, risks or noncompliance patterns. • Priorities were selected through an extensive stakeholder process including EPA program offices, states and state associations, tribes, regulatory partners and the public. • FY 05 – 07 priorities are: • Wet Weather (CSOs, SSOs, storm water, CAFOs) • Air Toxics • New Source Review/Prevention of Significant Deterioration • Petroleum Refining • Mineral Processing • Tribal • Financial Responsibility

  8. Implementing the Priorities • Strategies have been developed for each priority (non-public) • Detailed summaries of each priority are on EPA’s website: www.epa.gov/compliance/priorities/index.html • Each strategy has an implementation team
