Where does it apply ? • Everywhere – apart from a single private domestic dwelling • Risk Assessments have been a legal requirement since 1997
Responsible Person • Employer • Owner • Landlord • Managing Agents • Tenants • Occupiers The Person Who HasControlOf The Premises; May be devolved
Relevant Persons • Any person who may be lawfully on the premises; and • Any person in the immediate vicinity of the premises who is at risk from a fire on the premises
Competent Person The competent person or fire risk assessor need not possess any specific academic qualifications but should: understand the relevant fire safety legislation; have appropriate education, training, knowledge and experience in the principles of fire safety;
Competent Person have an understanding of fire development and the behaviour of people in fire; understand the fire hazards, fire risks and relevant factors associated with occupants at special risk within the buildings of the type in question, have appropriate training and/or experience in carrying out fire risk assessments.
General Fire Precautions Responsible person must :– Take such general fire precautions to ensure the safety of all employees Ensure the safety of all relevant persons who are not employees Also ensure that the premises are safe from fire
Article 11 fire safety arrangements ‘The responsible person must effectively plan, organise, control, monitor and review the preventive and protective measures’ The arrangements should be recorded – and must be if five or more employees, a licence is in force on the premises, or an alterations notice is in force
Risk Assessment • Must be suitable & sufficient, and carried out by a Competent person • Any significant findings should be recorded – and must be if five or more employees, a licence is in force on the premises, or an alterations notice is in force
Provide Information • Provide employees with information on – • Significant findings from the Risk Assessment • The preventive and protective measures • Dangerous substances – and • Before employing a child must provide this information to a parent of the child
Co-operation • Where there are two or more responsible persons (multi-occupancy) – • Each person must co-operate with the other to enable compliance with the requirements of the Order
Training • Provide employees with adequate safety training – • When first employed • If exposed to new or increased risks – and • Repeat periodically – 6 monthly in sleeping accommodation, 12 monthly otherwise
