  3. Purpose of Development Order • To guide land use and land use changes • To foster economic, environmental, cultural, physical, and social well-being • To ensure that social needs are addressed in an environment where market forces are likely to impact the outcome of the planning process

Purpose of Development Order Cont’d • To facilitate protection and conservation of the natural environment • To provide for decisions to be made in a transparent and accountable manner • To encourage cooperation and coordination among differing interests • To effect the most efficient use of limited resources in a manner that satisfies the need of the present generation without compromising the livelihood of future generations

What is a Development Order • A Development Order is a legal document which is used to guide development in the area to which it applies. • The Development Order includes the plan and related statements. • The Town and Country Planning Act is only applicable in an area where a Development Order exists.

  6. Who prepares a Development Order • The Town and Country Planning Authority after consultation with the Local Authority prepares a Provisional Development Order.

  7. Use of the Development Order • It enables the Local Planning Authority and/or the Town and Country Planning Authority to regulate land developments within the area defined as the Development Order Area. • It is used to secure proper conditions and conveniences and the co-ordination of roads and public services, protection and extension of amenities and the conservation and development of the resources of the area.

Contents of a Development Order • Define the boundary it relates to • Provides for the granting of permission to develop land in the order area • Contains provisions necessary or expedient for prohibiting or regulating the development of land in the order area • Matters to be addressed in the order: • Roads • Buildings and other structures • Community Planning • Amenities • Public Services • Transportation and Communications • Miscellaneous

  9. Contents of a Development Order: Roads • Reservation of land for roads and establishment of public right of way. • Construction of new roads and alteration of existing ones

Contents of a Development Order: Buildings and Other Structures • Limiting number of buildings or number of specified class which may be constructed. • Regulating and controlling objects which may be affixed to buildings • Regulating and controlling the design , colour and materials of buildings and fences. • Reservation or allocation of lands for buildings of a specified class or classes or the prohibition or restriction of any class or classes of buildings on specified lands. • Regulating and controlling manner in which buildings are used and for what purpose.

  11. Contents of a Development Order: Community Planning • Zoning of land for specific uses. • Regulating layout of housing e.g. density, spacing grouping and orientation. • Provision and siting of community facility e.g. schools, churches meeting halls.

  12. Contents of a Development Order: Amenities • Reservation of lands for • Open Space • Burial/cemeteries • Communal parks • Game and bird sanctuaries

  13. Contents of a Development Order: Public Services • Facilitate the establishment, extension or improvement of works in relation to refuse disposal • Power, water supply, sewerage disposal and drainage
