The Cost • Employee theft and dishonesty – $40 billion a year • Workplace violence – $36 billion a year • Employee substance abuse – $640 per US worker • Half of all new hires “don't work out” – $7,000 to $40,000 • Total You do the math!
Reason to Care • An employer may be liable for negligent hiring if: “The company knows the employee is unfit . . . fails to use reasonable care to discover the employee's unfitness before hiring.” Evan F. v. Hughson United Methodist Church (1992) 8 Cal.App.4th 823, 843.
The Solution “An employer . . . may avoid liability if it takes reasonable steps to authenticate the applicant's credentials.” Select the right employees from the start!
How? • Know what you are looking for: • Have a good job description • Understand your company, culture, and current employees • Screen people out, not in! • Get to know the candidate • Make sure they fit the description and the company characteristics
Slow to Hire • Have more than two interviews • Perform reference/background checks • Have them take assessment or personality tests • Make sure the interviewee: • Understands the company • Will fit in
Top 10 Interview Questions • Who are the best bosses you’ve ever worked for? The worst? • In the past, when have you not been successful and why? (Biggest disappointment professionally?) • What has been the thing you are most proud of professionally? • What percentage of your day do you spend on specific tasks? • What are five things you would change about your current job?
Top 10 Interview Questions • Tell me about any “best practices” you’ve instituted that you are particularly proud of. • Did you ever put a program in place that wasn’t successful? What was it and what did you learn? • Describe a situation with a client where you made a mistake. How did you handle the error? • Describe a couple of instances, big or small, where you took a different tack in achieving an objective than was the company standard? • Describe a time where a creative approach to meeting an objective didn’t work and what you did next?
