IDEA Accountability Process Six year plan. Original submitted Dec. 2005. Established original targets, benchmarks and improvement activities. Revised as data comes on line and as required by OSEP Compliance Determinations. State Performance Plan Annual report of progress on targets and benchmarks established in SPP. Revised as OSEP requirements are updated and as required by OSEP Compliance Determinations Annual Performance Report Annual evaluation of state’s compliance status. OSEP considers APR compliance, Uncorrected noncompliance, Timely and Accurate Data, and Audit findings. Compliance Determination Applied after 2 years as “Needs Assistance” and for “Needs Intervention” and “Needs Substantial Intervention.” Leads to special conditions and interruption of funding Sanctions
The SPP and the APR consist of 20 federally-required indicators. Ten are considered compliance indicators and ten are consider performance indicators.
Compliance Indicators require 95 to100% compliance at state level in order to get a compliance determination of “Meets Requirements” from OSEP. • The state is required to review data for each district and, if warranted, make a finding of noncompliance. District findings and corrective actions must be tracked and reported annually in the APR.
Performance Indicators are tracked in relation to state-established targets and benchmarks. • These targets and benchmarks were originally established in conjunction with a broad-based stakeholder group. • The targets and benchmarks have been approved by the State Board of Education in successive versions of the State Performance Plan. • The state reports progress or slippage in relation to the annual benchmarks each year in the APR.
The IDEA requires that CDE report publicly overall and that we publicly report on the first 14 indicators at the district level. • Six are compliance indicators and eight are performance indicators. • The compliance indicators must be used as a part of the LEAs compliance determination

General Requirement • 34 CFR 300.600(a) The State must monitor the implementation of this part, enforce this part in accordance with § 300.604(a)(1) and (a)(3), (b)(2)(i) and (b)(2)(v), and (c)(2), and annually report on performance under this part.
Overall Determinations 34 CFR 300.603 (b) Determination—(1) General. Based on the information provided by the State in the State’s annual performance report, information obtained through monitoring visits, and any other public information made available, the Secretary determines if the State— (i) Meets the requirements and purposes of Part B of the Act; (ii) Needs assistance in implementing the requirements of Part B of the Act; (iii) Needs intervention in implementing the requirements of Part B of the Act; or (iv) Needs substantial intervention in implementing the requirements of Part B of the Act.
