  1. Pesticide Container Recycling Rule Proposal Status report for the Western States Meeting May 17, 2007

Summary of Proposal • Mandatory for registrants of agricultural and professional specialty pesticides • Requirement to recycle a quantity of HDPE containers equal to a % of the total weight used during the previous calendar year • Recycling programs must comply with ANSI/ASABE safety standard and be certified by an accredited, independent third party • Minimal recordkeeping and reporting

  3. Summary (cont’d) • Registrants given flexibility on how to comply • Own program, group program, partner with state programs • No geographic requirement • However, we’re asking for comments on possibilities • Can recycle adjuvant containers to count towards their required amount

  4. Status • 1st draft of preamble & reg text reviewed internally by other EPA offices on work group • 6 out of 7 offices concurred • Wrote 2nd draft to resolve issues • Meeting this week • Now in review by OD

  5. Next Steps • Review & sign-off by OD, then AA • OMB begins 90-day review on June 13th • On target for an Oct. 31st publication date for 60 day public comment
