Fishery Management Plan (FMP) for the BSAI King and Tanner Crabs • FMP establishes State/Federal cooperative management regime • Crab management deferred to State with Federal oversight • 3 categories of management measures defined under the FMP • Category 1: Fixed. FMP amendment to change. • Category 2: Frameworked. State has flexibility within the criteria specified for frameworked measures. • Category 3: Discretionary. State can change through own process.
Management measures (cont) • FMP must meet requirements of Federal laws and regulations • Compliance with amendments to MSA (e.g. SFA 1996) • For BSAI Crab FMP Federal requirements are Category 1 measures fixed in the FMP and requiring an FMP amendment to change • MSA revisions in 1996 (SFA): • Defined ‘overfished’ and ‘overfishing’ • Required all FMPs to specify objective and measurable criteria for ID when fishery is overfished (and if overfished or approaching overfishing, contain mgt measures to prevent and rebuild) • Councils must submit amendments by October 11, 1998 to bring FMPs into compliance
Amendment 7 to Crab FMP • Amendment 7 revised definitions of overfishing, MSY and OY (work by members of Crab Plan Team) • Adopted by NPFMC in June 1998 • Effective date March 3, 1999 • Measures under Amendment 7: • Revised OY, MSY, overfishing • MSY Control rule = natural mortality rate (M). Fixed values for king crab (M=0.2) and Chionoecetes sp (M=0.3) • MSY stock size = average mature biomass observed between 1983-1997 • Overfishing rate = fishing rate >M • Minimum Stock Size Threshold (MSST) = ½ MSY stock size • Stock is considered overfished if mature biomass below MSST.
Overfished and overfishing • MSA requirement section 304(e) that Secretary report to Congress and Council on status of fisheries and identify fisheries that are overfished or are approaching an overfished condition. • Status determination made using criteria specified in FMPs • If fishery is overfished SoC must notify the Council. Council must take action within 1 year of notification to prepare FMP amendment for purposes of ending overfishing and rebuilding stock.
NPFMC’s overfished stocks since implementation of Amendment 7 • BS Tanner (1998 declaration, 2000 RBP adopted, amd 11). Currently under rebuilding plan. Small harvest in western stock in 2005-2006 (Eastern remains closed). • Snow crab (1999 declaration, 2001 RBP adopted, amd 14). Currently under rebuilding plan. Some harvest under rebuilding plan. • St. Matthew BKC (1999 declaration, 2000 RBP adopted, amd 15). Currently under rebuilding plan. Fishery closed. • Pribilof Island BKC (2002 declaration, 2003 RBP adopted, amd 17). Currently under rebuilding plan. Fishery closed.
Crab Plan Team decision to revise definitions • In crafting amendment 7 team declared their intent to “review [MSY] estimates on a 5 year review cycle or in the event that environmental conditions signal a regime shift” (EA for Amd 7, 1999) • 2003 CPT meeting: team reviewed current definitions and decided to revise current defintions. • Workgroup created: Lou Rugolo (NMFS), Shareef Siddeek (ADF&G), Jack Turnock (NMFS) and Jie Zheng (ADF&G) • Guidance to workgroup and initial timeline for amendment provided in CPT minutes.
Process for FMP amendment Workgroup crafts new definitions (tier system etc) CPT designates WG Review and Feedback: SSC CPT Suite of alternatives developed and analyzed (EA): includes analysis of current definitions (status quo) and environmental effects Consultation with BOF Initial Review by Council Document released for public review Revisions Final Action by Council: Council selects preferred alternative Document sent to SOC SOC Approval Rules promulgated FMP amendment official
