INTRODUCTION • This presentation primarily focuses at notable changes that may be brought about by the proposed amendments to NLTA on the subject of IPTNs should the current Bill [B 7D-2016] be passed into law . • The structure and the level of presentation considers the diversity of the audience present at this conference. • The content of the presentation is informed by law and experience on the subject.
KEY DEVELOPMENT AND IMPLEMENTATION DOCUMENTS FOR IPTNS IN SOUTH AFRICA • White Paper on National Transport Policy (1996); • Public Transport Strategy(PTS) and Action Plan (2007); • National Land Transport Act, 2009; • Minimum Requirements for Preparation of ITPs, 2016; • Consolidated IPTN Guidance V4 January 2018
NATIONAL LAND TRANSPORT ACT , 2009 • Definitions : • IPTN = a system in a particular area that integrates public transport services between modes, with through-ticketing and other appropriate mechanisms to provide users of the system with optimal solutions to be able to travel from their origins to destinations in a seamless manner; • ITP = an integrated transport plan contemplated in section 36 ( NB read with 2016 Regulations)
NATIONAL LAND TRANSPORT ACT , 2009 • Section 14 (a)- all planning authorities must prepare the ITPs as contemplated in section 36; • Section 15(1)- every municipality that is establishing an integrated public transport network or has significant passenger rail services in its area must establish an intermodal planning committee consisting of the prescribed technical officials and prescribed representatives of rail operators , other transport modes , users and organised business.
NATIONAL LAND TRANSPORT ACT , 2009 • Section 18(5) – every municipality that establishes an ITP must in the prescribed manner establish a call centre where passengers and other interested persons may lodge complaints or inquiries regarding public transport in its area… • Section 31 – land transport planning must be integrated with land development and land use planning processes & ITPs required by this Act are designed to give structure to the function of municipal planning mentioned in Part B of Schedule 4 to the Constitution...
NATIONAL LAND TRANSPORT AMENDMENT BILL, • Definitions: • IPTN= means a system in a particular area that integrates public transport services between modes, including non-motorised transport, with through-ticketing and other appropriate mechanisms, that may be implemented in a phased manner, to provide users of the system with the optimal solutions to be able to travel from their origins to destinations in a seamless manner with integrated pedestrian access for all passengers, and may, in appropriate municipalities, include-
NATIONAL LAND TRANSPORT AMENDMENT BILL, - (a)integrated rapid public transport networks, being high quality networks of car competitive public transport services that are fully integrated regardless of mode, and may or may not have a dedicated right of way , with or without bus rapid transit systems; and -(b) bus rapid transit systems, which are high volume bus corridors served by an integrated feeder system;
NATIONAL LAND TRANSPORT AMENDMENT BILL, • Non-motorised transport = transport by any mode other than a motor vehicle including , but not limited to, walking , cycling and animal-drawn vehicles and motorised or non-motorised wheelchairs; • Accessible and non-motorised transport Section 10A is a new insertion that enjoins the Minister, all MECs and planning authorities to take steps in performing their functions under the Act to promote accessible transport and non-motorised transport. Accessible transport is comprehensively defined .
NATIONAL LAND TRANSPORT AMENDMENT BILL, • Section 15(1) is amended to provide for the Minister to prescribe a deadline for the establishment of intermodal planning committees (IPC) as well as to limit participation only to prescribed technical officials and prescribed representatives of state-owned rail operators; • Section 15(2) is amended to clarify the functions of IPC as to co-ordinate and integrate public transport as well as all other aspects relating to the ITP of the municipality and to perform other prescribed functions in order to achieve the objects of the Act;
NATIONAL LAND TRANSPORT AMENDMENT BILL, • There are additional two subsections inserted in section 15, being (3) and (4). • Subsection (3) provides that where there are significant passenger rail services in the area, the IPC must facilitate the conclusion of SLAs between the municipality and PRASA; • Subsection(4) provides for the taking over of the IPC functions by a provincial entity established in terms of the amended section 12(1);
IMPLICATIONS OF AMENDMENTS TO IPTNS • Expanded and assistive definition of what IPTN entails for various planning authorities; • Inclusion of non-motorised transport in the definition of IPTN as newly defined in the Bill; • New obligations for the Minister, all MECs and planning authorities as imposed by section 10A with regard to accessible and non-motorised transport; • Amendment of section 12 to provide for establishment of a provincial entity that must take over certain provincial and municipal functions related to IPTNs
IMPLICATIONS OF AMENDMENTS TO IPTNS • Reconfigured IPC and additional functions with possible regulations on deadline for the IPC establishment as well as further functions. • Exclusion of other public transport modes, users and organised business as members of the IPC; • Possible amendment of Minimum Requirements for Preparation of ITPs, 2016 & Consolidated IPTN Guidance V4 January 2018
IMPLICATIONS OF AMENDMENTS TO IPTNS • Possible relief for some municipalities that exploit the new amendments to reduce planning obligations; • Increased provincial powers to assist municipalities with transport planning ; • Possible consolidation of resources and skills by the planning authorities in a province with those of the province in order to fulfil obligations on IPTNs.
