Tukinainen, the support center for victims who have been sexually assaulted (NGO) • provides help, support and guidance for persons who have been sexually assaulted, raped and/ or abused and for their families - the therapeutic and legal help of Tukinainen is free of charge for victims • influences the professional and legal procedures, as well as the authorities and public opinion in order to decrease and prevent sexual assaults experienced by women and girls (about 90% of sexually assaulted are girls/ women) • provides cooperation, consultation and training for professionals, authorities, organisations and educational institutions in a variety of fields • supplements the social and health services as well as official system in its own special field

Help, support, guidance, consultation, training • a free crisis telphone line and a free legal telephone line • groups for victims, a variety of fixed groups and groups for persons close to the victim • personal appointments with a crisis counsellor and/ or lawyer • legal assistance and support in connection with a trial, report of an offence and preliminary investigation • tailored consultation, trainingand work guidance liable to charge for professionals in a variety of fields

Sensitivity training programme Senja-project • Main tasks: • 1)educate employees such as police, police students, prosecutors, judges, legal aid personal, laywers who are working in proceedings and are facing sexually abused people • In the year 2010 almost 500 participants took part of the sensitivity training and 300 of them were police officers • 2) victims of sexual violence will not experience secondary traumatisation or secondary victimisation in proceedings

Legal Aid doesn’t depend on the income of the victim • All victims of sexual violence or domestic violence as well as victims of trafficking have right to a cost-free legal adviser/assistant: • During the police investigation (reporting, hearing) in all cases • In all stages of a trial, if the prosecutor prosecutes for an offence and the victim demands compensation for damages

Finnish Penal Code Chapter 20 Sexual offencesViolence as a essential element of Rape • Section 1 - Rape • A person who coerces another into sexual intercourse by the use of violence or threat of violence shall be sentenced for rape to imprisonment for at least one year and at most six years. • A person shall also be sentenced for rape if he/she takes advantage of the incapacity of another to defend himself/herself and has sexual intercourse with him/her, after rendering him/her unconscious or causing him/her to be in such a state of incapacity owing to fear or another similar reason. • An attempt is punishable.

Finnish Penal Code Chapter 20 Sexual offences Section 5 - Sexual abuse • a patient in a hospital or other institution, whose capacity to defend himself/herself is essentially impaired owing to illness, handicap or other infirmity; or • - a person who is especially dependent on the offender, where the offender blatantly takes advantage of the dependence, shall be sentenced for sexual abuse to a fine or to imprisonment for at most four years

Finnish Penal Code Chapter 20 Sexual offences Section 5 - Sexual abuse • A person shall also be sentenced for sexual abuse if he/she takes advantage of the incapacity of another to defend himself/herself or to make or express a decision, owing to unconsciousness, illness, handicap or other helplessness, and has sexual intercourse with him/her, or gets him/her to perform a sexual act essentially violating his/her right of sexual self-determination or to submit to such an act.(This will be moved to Chapter 20 Section 1 RAPE) An attempt is punishable.
