JUSTIFICATION The U.S. Supreme Court on June 14, 1990 upheld the use of sobriety checkpoints to detect and deter impaired drivers. Previous appeals to the Supreme Court to review the constitutionality of such checkpoints had been declined, which allowed high state court rulings to stand. The June 14, 1990 ruling “clearly upheld the constitutionality of such enforcement measures.”

MICHIGAN vs. SITZ Impaired enforcement is constitutional because this small inconvenience was overwhelmed by a compelling state interest in saving lives.

Authority and Jurisdiction • Authority • Must be a P.O.S.T. certified LEO • Must meet the P.O.S.T. requirements for the Operation Area • Additional requirements • SFST certified, BA certified, Supervisor Checkpoint Certified, OSHA requirements, High Visibility impact REQUIREMENTS
JURISDICTION Under normal circumstances you work under your jurisdiction. When using a Multi Jurisdictional Enforcement Unit, it is simpler to work under the authority of the Sheriff with a Mutual Aid Agreement
MUTUAL AID AGREEMENT • Under Article VI, Section 16 of the Constitution of the State of Missouri, pursuant to RSMO. 70.815.2 grants the authority to operate under Missouri law. • The Mutual Aid Agreement must be adopted between all entities participating in a joint Multi Jurisdictional Enforcement Unit. This must include all participants i.e. law enforcement, traffic safety, and governmental administrations. • Review the Mutual Aid Agreement (Handout)
