  3. Genetic Privacy Act California is currently debating a bill that would protect its citizens from DNA testing without their consent. Pros • Protects privacy and sensitive information • Diseases • Classified family information • People could not know your genes without permission Cons • Research would suffer • Before they store huge databases of DNA • $594,000 • More of a hassle to get genetic testing done

Cloning • Dickey-Wicker Amendment(1996)-illegal to use federal funds to support research “...in which human embryos are created, destroyed, discarded, or knowingly be subjected to risk of injury or death…” • No legislation that prohibits cloning for either therapeutic or reproductive purposes. • Human embryos are “any organism, not protected as a human subject under 45 CFR 46.

  5. Cloning • States that ban cloning both therapeutic and reproductive: • Arkansas • Indiana • Iowa • Michigan • N. Dakota • S. Dakota • Virginia • Maryland bans specifically reproductive cloning. • States that ban public monies for the use of cloning: • Arizona • Missouri • States that allow therapeutic cloning: • California • Missouri • New Jersey • Rhode Island • Connecticut

Genetic Laws Concerning Children • “Wrongful Birth” Cases • Genetics used to determine likelihood of inherited diseases • Down Syndrome • Tay Sachs • Cystic Fibrosis • asdf • Parents suing over mistakes in predictions • Argue for money to pay for the cost of the disability • Didn’t create the underlying genetic problem • Ethical Question: Price on life? • 30 states have ruled in favor of the “wrongful life” cases • Malpractice or Negligence

Who Regulates? • Federal Food, Drug, and Cosmetic Act and the Public Health Service Act provide sufficient authority for federal health agencies to regulate research on human genetic modification. • Agencies: • FDA • Recombinant DNA Advisory Committee(RAC) • National Institutes of Health(NIH) • The Center for Biologics Evaluation and Research(CBER) • What they regulate: • Human germline genetic modification • Gene Therapy • Human gene therapy products • NIH has set guidelines for agencies that receive federal money.
