Objectives of Orientation • Familiarize providers with the Partial Emancipation Law and the impact of the law • Distinguish and determine the difference in issuing a license for a program versus a facility and laws that govern the operation of the YTHP • Discuss some key points of rule 409 and the process for issuing a YTHP license • Allow providers to provide feedback and suggestions

  6. Purpose of the YTHPRule 409 The purpose of this Part is to prescribe the standards for licensure as a Youth Transitional Housing Program and to describe how to apply for such a program license. Procedures 409 gives direction to staff on how to license a YTHP The licensing standards set forth in this Part are applicable to Youth Transitional Housing Programs as defined in the Children and Family Services Act [20 ILCS 505/4b] and in the Emancipation of Minors Act [750 ILCS 30]. An individual or organization that operates a Transitional Housing Program only for youth ages 18 and older is exempt from licensing under this Part.

Section P 409.10b) Purpose • Allows a licensed YTHP to operate in the same building with, and in conjunction with programs that serve persons 18 years of age and over provided that supervision requirements in Rule 409 and these procedures are met and the sleeping quarters of YTHP youth are secure and separate from persons, other than staff, who are 21 years of age and older or wards of DCFS.

Youth in Transitional Housing ProgramPurpose • YTHP was created to enable providers already serving homeless and/or foster care youth in a facility to be able to (affordably) also house partially emancipated homeless youth 16 and 17 years old. • Partial emancipation process gives these youth the ability to consent to a YTHP.

  9. PURPOSE CONTINUED • Results in a longer-term more stable living arrangement than emergency shelters permit. • Though YTHP’s are a distinct program, it is not intended to be physically separated from other programs or all other youth and adults • There are age restrictions for the sleeping areas.

  10. Important DefinitionsP 409.20 • “Facility” means the building in which the YTHP and/or other programs operate. • “Housing” means the secure area in which beds of non-ward youth ages 16-20 are located.

Important Definitions con’t • “Homeless youth or homeless minor” means a partially emancipated youth 16 or 17 years of age who may be admitted to the YTHP, but may remain in the program until 18 years of age. Youth in the guardianship of DCFS are not eligible for this program. The minor child of a resident may be admitted to the YTHP with his or her parent. • “Resident” means youth admitted into the YTHP and/or other individuals living in the same facility.

Section P409.220f) Supervision of Residents • Document how a facility that also operates a homeless adult program provides separate sleeping quarters for YTHP youth and their children to prevent access to youth sleeping quarters by others served in the building who are 21 years of age and over (examples may include: separate floors, separate wings of a building, walls with operable and secure doors).

  13. Section P409.220g) Supervision of Residents • Verify that the sleeping quarters of the YTHP youth cannot be accessed by persons 21 and over. When YTHP youth are commingling with adults served in the same building (e.g. dining areas, recreational areas, workshops, classes, trainings), describe how staff will continue to supervise the YTHP youth.

Section P409.220 (h) Supervision of Residents • Observe that when the YTHP operates within a licensed facility, the sleeping quarters of the YTHP youth is separate from residents who are under the guardianship of the Department and residing in the licensed facility. • Document on the floor plans how these sleeping areas are separate.

  15. Section P409.230a) Physical Facilities Discuss that while programs in the same building, other than the YTHP, may house persons 18 years of age and over, no one 21 years of age or older, except staff, is permitted in the sleeping area of the YTHP.

  16. Facility Capacity- P 409.240 • The capacity is determined by several factors, but shall not exceed 24 residents for the first year of operation • Children of youth housed in the YTHP shall be counted in the capacity.

  17. Section 409.270i) Admission Criteria Any youth, aged 18 years old up to 21 years old, who is housed in the facility, where the YTHP is located, shall meet the admission criteria required for homeless youth participating in the YTHP and shall have completed a comparable screening and assessment.

  18. Admission Criteria • This means that non-YTHP youth should enter the facility on their own volition, should not pose a serious threat to themselves or others, and should not have a contagious disease. • Non-YTHP youth would not have to present documentation of partial emancipation, but should go through a “comparable screening and assessment.”

  19. Section 409.290 Length of Stay • From Rule: “Homeless youth can remain in the transitional living program (YTHP) up to attaining the age of 18 years. From 18 years of age and up to 21 years of age, the person can participate in another program within the facility, if available.” • From Procedures: “Discuss that there is no maximum number of days a youth may remain in a YTHP, as long as he or she is under the age of 18.”

  20. Length of Stay • Clarification: Youth who turn 18 may continue to stay in the facility and continue to share sleeping quarters and all programming with YTHP youth. However, they must be designated as being in another program in the facility. Youth who turn 21 also may continue to live in the facility and share programming with YTHP youth as long as they have separate sleeping quarters and are designated as being in another program.

  21. In summary… • These sections of the procedures show that YTHPs can exist within a facility that houses and provides services to youth and adults 18 years of age and older, including wards. • Sleeping quarters of YTHP youth are restricted to youth through age 20 who are not wards of the state.

  22. Also…. • YTHP youth and other youth and adults over 18 years old (including wards) may utilize common spaces together. • Other youth and adults residing or participating in the same facility with YTHP youth should meet similar criteria and complete a comparable screening and assessment.

  23. And Finally… • YTHP youth who are 18 and older may continue to participate and/or reside in other programs in the facility.

  24. Who Can Apply for YTHP licensure? • Licensed Facilities – Group Homes, Youth Emergency Shelters, and Child Care Institutions • Facilities, Agencies, and Organizations who are willing or will provide services to partially emancipate youth ages 16-17 years of age.

Licensed Facility Application Attachments • Copy of Facility License • A copy of the Articles of Incorporation and by- laws indicating the organization’s corporate status is in good standing with the Ill. Sec. of State’s Office and if not-for-profit, a copy of the IRS ruling on the exemption status from federal income tax (501(c)(3) and registration with the Charitable Trust Bureau of the Ill. Atty. General’s Office.

  29. Licensed Facility Application Attachments • Statement of purpose including the types of youth that will be cared for. • Program Plan • A comprehensive staffing plan including job descriptions and qualifications of staff
