Chesapeake Bay Program PartnershipChesapeake Bay Strategic Implementation Plan:Wastewater Sector Draft State Meeting SummaryWastewater Treatment Workgroup MeetingJanuary 31, 2008
State Meeting DatesEPA Chesapeake Bay Program Office/Water Protection Division Meetings with the Six Watershed State Partners • With MD on Oct 26, 2007 • With NY on Nov 13, 2007 • With VA on Dec 6, 2007 • With PA on Dec 10, 2007 • With WV on Jan 15, 2007 • With DE on Jan 18, 2007
State Meeting Background • Recent FAQ: • How are we doing in meeting the 2010 goals ? • Where will we be by 2010? • When will we meet the load reduction goals? • Addressing wastewater loads is a critical component of the Bay Strategic Implementation Plan. • We need to be able to answer those FAQ and tell our Story.
State Meeting Objectives • To learn from our state partners on what's happening, their current schedules, issues they are facing, and etc. • Talking through issues that we eventually want to bring forward through our joint Wastewater Treatment Workgroup for resolution and partner consensus • Using the input from the state partners to further flesh out the wastewater sector component of the Chesapeake Bay Program's Strategic Implementation Plan
State Meeting Findings Major Commonality and Difference Commonality: No matter where we are in the Watershed, we are working together toward the same goal – Bay water quality restoration Difference: State partners are not on the same starting line. MD, VA, PA and DC actively participated in the previous Tributary Strategy implementation started in mid 1990s for the year 2000 goals, while the headwater states just joined the partnership after 2000.
State Meeting Findings Lists of significant facilities are all finalized in all Bay states.
State Meeting Findings All significant facilities, including both municipal and industrial facilities, will be permitted by 2010.
State Meeting Findings Compliance Schedules: MD: Compliance plans are specified in the permits and will be all available by 2010. NY: To be determined during the permitting process based on assigned action level. VA: VA Compliance plan is finalized. The first calendar year for compliance is 2011.
State Meeting Findings Compliance Schedules: PA: Phase 1 facilities (27 plants) by 10/1/2010 Phase 2 facilities (39 plants) by 10/1/2012 Phase 3 facilities (147 plants) by 10/1/2013 One full compliance year is required before getting full compliance. WV: Not available yet for most facilities Only few plants submitted requested action plans. DE: Current TMDL compliance by 2010
State Meeting Findings Trading Progress: MD: Maryland point to point trading policy will be available by the end of 2007. Nutrient trading program is planned mainly for cap maintenance NY: Nutrient trading/offset will be considered in the tributary strategy’s Level Four
State Meeting Findings Trading Progress: MD: Maryland point to point trading policy will be available by the end of 2007. Nutrient trading program is planned mainly for cap maintenance NY: Nutrient trading/offset will be considered in the tributary strategy’s Level Four
State Meeting Findings Trading Progress: VA: The trading program is operated through the Nutrient Credit Exchange. Wastewater treatment facilities can secure nonpoint source credits only if point source credits are not available for purchase. New and expanding facilities must acquire sufficient credits to offset new discharge. PA: Trading policy was put in place to allow point to point, point to non-point and third party trades. Currently, there are 26 approved trade proposals and 3 completed trades.
State Meeting Findings Trading Progress: WV: WV is planning for a trading program for the Potomac Basin in WV and should be in place in late 2008 or early 2009. DE: No basin wide trading plan available, but trading could happen case by case.
State Meeting Findings Facility Upgrade Tracking: MD: A solid and in-depth tracking and reporting system in place for the facility upgrade progress. • Status tracked monthly (sometimes weekly) • On record: construction starting date, complete date, full operation starting date and etc. • Technology and cost are also tracked. NY: Not in place yet for all facilities.
State Meeting Findings Facility Upgrade Tracking: VA: Facility upgrade progress has been tracked on the annual basis. Construction schedules for facility upgrades are detailed in the compliance plan. The WQIF grant agreement requires facilities to report the upgraded treatment technology and cost information. The WQIF grantalso require enforceable concentration-based performance
State Meeting Findings Facility Upgrade Tracking: PA: Not in place yet WV: Not in place yet DE: DE has tracked the facility upgrades for all three significant municipal facilities.
State Meeting Findings Growth Projection: MD: Not done NY: Not done, no growth is expected VA: Flow and load projection out to 2030 PA: Flow projected to 2017 for some facilities planning upgrades. WV: Not done DE: Not done
State Meeting Findings Funding: MD: Maryland’s Bay Restoration Fund (BRF) The possible funding gap is expected to happen by 2012 mainly due to Blue Plains NY: SRF and Environmental Protection funds VA: Virginia Water Quality Improvement Fund (WQIF), possible funding gap is expected between 2009 and 2010
State Meeting Findings Funding: PA: SRF, no state plan for direct funding. WV: SRF, no state plan for direct funding DE: All projects are funded, no funding gap expected
State Meeting Findings Support from EPA and other CBP partners: MD: Resource and information sharing from EPA CBPO and other CBP partners. NY: Phase 5 model simulation and information sharing from other CBP partners VA: Water quality model confirmation scenario run for the final VA TS
State Meeting Findings Support from EPA and other CBP partners: PA: CBP research projects and informationsharing from other CBP partners. WV: Federal Funding and information sharing from other CBP partners DE: Work on the Bay nutrient permit limits based on the Bay TMDL.
State Meeting Findings More findings: • Information sharing among the CBP partners is the most commonly requested additional support • Nutrient monitoring requirements have been included in permits in all states. • e-DMR is in place in VA and PA, and evaluated in WV. • Non-significant facilities will be permitted in PA and WV
State Meeting Findings Questions ? NextDiscussion on Facility Upgrade Tracking
