  5. A advogada Regina Beatriz Tavares da Silva, 44 anos, afirma que o cônjuge ou companheiro que se recusa a ter relações sexuais pode ser condenado judicialmente a indenizar o outro.

  6. Disse ela à Folha de São Paulo:

  7. "Uma das obrigações matrimoniais é a de os cônjuges manterem contato sexual.

  8. O fato de um dos cônjuges se negar a fazê-lo é motivo para um pedido de separação."

  9. Também é motivo para um pedido de indenização?

  10. Dra. Regina complementa : "- Sem dúvida. O descumprimento de todos os deveres conjugais, uma vez que exista dano, gera ao ofendido o direito de pleitear indenização".
