Directive 2001/14/EC • On the allocation of railway infrastructure capacity and • the levying of charges for the use of railway infrastructure capacity and • safety certification

Charging levels at the end of the ‘90s (for illustrative purposes only) Average charging levels in € per train.km
Rail infrastructure charges (I): • determined by infrastructure manager or independent charging body • set at the cost that is directly incurred as a result of operating the train service (general principle) • environmental charging element (optional, should not lead to overall increase of revenue of infrastructure manager) • compensation schemes for unpaid environmental, accident and infrastructure costs in competing modes (optional)
Rail infrastructure charges (II): • Exceptions: • Mark-ups that the market can bear • Higher charges for specific investment projects • Discounts (development of new services, underutilised lines) • Performance scheme to increase efficiency of infrastructure use (e.g. bonus/malus scheme)
The capacity allocation process: • determined by infrastructure manager or independent charging body • transparent through publication in network statement • Train paths re-attribution every year • In case of congested infrastructure: capacity analysis and enhancement plan • priority rules • international co-operation of infrastructure managers
The Network Statement • published yearly • describes the technical characteristics and references of the capacity available • indicates the charging regime • indicates the priorities and the allocation procedure
The regulatory body: • Independent from any infrastructure manager, charging or allocation body or any applicant for capacity • Appeal body for decisions regarding network statement, in particular, allocation process, charging scheme, enforcement and monitoring of safety requirements • Has power to request information • Must determine any complaints within 2 months • Can require Infrastructure manager to modify decision
Safety Certification • Same requirements as in Directive 95/19/EC but now apply to all railway undertakings with a Community licence. • Safety certificate issued under national rules in a non-discriminatory manner
