NPAs 26 STATUS and JAA/EASA COORDINATION OPTIONS IDENTIFIED BY OST 05-2, REGARDING JAR-26 POSITION a) migrate JAR-26 into JAR-OPS 1, as a new Appendix: b) keep JAR-26 as a stand-alone rule and update it (with existing NPAs) until taken over by EASA; c) hand over JAR-26 to EASA and establish liaison with JAA, for operational issues. If the OST favours option “b”, the following JAA/EASA joint proposal for short-term strategy on managing NPAs 26, is submitted for consideration: WP 35-05
NPAs 26 STATUS and JAA/EASA COORDINATION • PROPOSED STRATEGY for MANAGING EXISTING NPAs 26 • Until EASA establishes competence for operational issues, JAR-26 remains JAA responsibility; • Coordination JAA/EASA would be needed, for updating JAR-26 with the existing NPAs, as indicated in the Tables contained in WP 35-05; • In case an NPA 26 has not been completed, and immediate action is required in relation to a specific aircraft type, the Agency can use the Airworthiness Directive tool, to impose corrective actions; • Rulemaking tasks on similar subjects in CS 25 and JAR-26 should be joint • (if requested by EASA - one drafting group, one Authority taking the lead); • Where an EASA drafting group for CS 25 rulemaking task will also produce the JAR-26 NPA, the EASA group should be composed of members of CSSG; • The EASA drafting group would report to EASA Rulemaking Directorate for the CS 25 issue and to the CJAA OPS DIV, for the JAR-26 issue.
