  1. Status Update on ETI Transition to Competition Plan (TTC) Filing Entergy Transmission Planning Summit July 29, 2008

Regulatory and Legislative Requirements • HB 1567 passed in mid--2005 required Entergy Texas to: • Not later than January 1, 2006 file a plan with the commission for identifying the applicable power region or power regions that might ultimately support retail open access. • Not later than January 1, 2007 file a "transition to competition plan", identifying in part how the company plans "to achieve full customer choice" (interpreted to be synonymous with retail open access, or ROA).

  3. Entergy’s TTC Filing • On December 29, 2006 Entergy filed a plan identifying two power regions that might support ROA: (1) ERCOT, (2) the Southwest Power Pool (SPP). • On June 4, 2007 Entergy filed a modified plan identifying three alternatives for integrating ETI into ERCOT.

  4. The Public Utility Commission of Texas (“PUCT”) Abatement Order • In docket No. 33687, the PUCT: • Abated the TTC Plan docket, and ordered Entergy to request SPP to conduct an analysis similar to the Phase II Entergy Integration Report completed by ERCOT in 2006. • Approved a work plan and timeline proposed by SPP regarding the work on its analysis. • Directed ERCOT to update its Phase II study contemporaneously with SPP's study. • Ordered Entergy to provide an updated analysis of the costs and benefits of Entergy Texas remaining in SERC." • Web site: http://www.puc.state.tx.us/index.cfm
