Scope of Competence of the Agency • Currently Regulation 1592/2002 establishes Community competence only for the regulation of the initial and continuingairworthinessand environmental compatibility of products • Work has being done to extend the scope of this Regulation to air operationsandpilot licensing (Opinion 3/2004) • The Commission will publish before the summer a communication related to the future competences of EASA (airport operations and air traffic control services) Part-145 Part-M

Mission of Directorates • Rulemaking • Assist the European Commission and in preparing legislation, (Opinions) and support the Member States and industry in putting the legislation into effect • Adopt our own certification specifications and guidance material • Certification • Conduct technical inspections and issue certificates where centralised action is more efficient • Quality & Standardisation • Assist the European Commission in monitoring the application of European Community legislation regarding aviation safety • Quality assurance function to monitor the Agency procedures Part-145 Part-M

The Management Board • is composed of one representative per Member State, plus one representative of the Commission • deals exclusively with administrative matters: work programme and priorities, budget, staffing, financial regulation, working methods (rulemaking procedure) • appoints the members of the Board of Appeal • appoints the Executive Director and the Directors Part-145 Part-M

The Board of Appeal • acts as a first administrative instance to verify the legality of the acts of the Agency • is created on an ad hoc basis: the chairperson and the other members shall be appointed by the Management Board from a list established by the Commission • its members shall be independent • its decisions are binding on the Agency • an appeal may be brought before the Court of Justice of the European Union against decisions of the Board of Appeal Part-145 Part-M

Conclusions • EASA is operational, growing in strength and expanding its scope • EASA is built on a strong legal basis which provides certainty to stakeholders • EASA is the principal civil aviation authority in Europe, with clearly established lines of roles, tasks and responsibilities • relationships with other countries are key to ensure the highest level of safety worldwide • EASA is the European interlocutor for civil aviation safety Part-145 Part-M

  23. Main changes to Part-145 • Changes introduced due to the extension of Part 66 to include aircraft below 5700 kg. Note this is a significant change to 145 and 66. • Levels of text changed (AMC moved to rule) • Changes for consistency with Regulation 1592/2002 and other codes i.e. Parts 21, M and 66 • Part-145 no longer defines when a Part 145 Approval is needed as this is defined in Part M.A.201(h) • Inclusion of JAA maintenance TGL’s Part-145 Part-M

  30. 145.A.30(i) • Refers to Part-66 for component certifying staff requirements. • Part-66 states that National rules apply until development of the Part 66 requirement • Component certifying staff should be issued authorisations on the basis of appropriate competence, training and experience . Part-145 Part-M

  34. 145.A.30(j)Derogations for Certifying Staff 145.A.30(j)(5) Unforeseen one-off authorisations combine the following:- (i) new text from TGL 42 (single event authorisation) (ii) old text for requiring an ICAO licence with 5 years experience Procedures in MOE for certification procedures (2.16) and Authorisation procedures (3.4) Part-145 Part-M

  35. 145.A.35 Certifying Staff and Category B1 and B2 Support Staff • Title changed • B1 / B2 support staff need; • an adequate understanding of the aircraft • recency • continuation training • competency assessed through 145.A.30 (e) • New paragraph (b) from JAR-66 regarding the need for the authorisation to be issued / renewed on the basis of a valid Part-66 license subject to the staff remaining in compliance with Part-66 Part-145 Part-M

  36. 145.A.35(c) Recency • 6 months in 24 recency – applies to certifying staff B1 and B2 support staff and component certifying staff • Component certifying staff recency is a new requirement • Organisation should be able to demonstrate recency is being assessed • MOE 3.4 issue / renewal of authorisationshould capture recency Part-145 Part-M

  37. 145.A.35(j) • Retention of records for certifying staff now includes B1/B2 support staff • The staff records shall contain; 1. details of any aircraft maintenance licence held under Part- 66; 2. all relevant training completed 3. the scope of the certification authorisations issued, where relevant, and 4. particulars of staff with limited or one-off certification authorisations Part-145 Part-M

  38. 145.A.35(m) Minimum Age Minimum age for certification privileges is now 21. Text comes from JAR-66, there is an age requirement of 18 years in Part-66. This currently applies to aircraft certifying staff only This includes pilot authorisations (was in TGL38) Part-145 Part-M

  39. 145.A.42 Acceptance of Components • New paragraph (From TGL11) (a) Parts to be classified, ie Form 1, standard parts, materials, unserviceable, unsalvageable (b) Eligibility of component prior to installation - was 145.50(c) (c) Fabrication of parts (TGL9) (d) Scrapping of unsalvageable parts Part-145 Part-M

  40. AMC145.A.70(a)Maintenance Organisation Exposition • Exposition layout comes from previous JAR 145 Appendix 2. • New sections: 2.28 Production planning procedures 3.14 Competence of personnel • Exposition may be electronically processed. Part-145 Part-M

  41. 145.A.90 Continued Validity • Approval certificates are no longer limited in duration. • The approval certificate remains valid, provided; • in compliance with Part-145 taking into account the provisions of findings. • competent authority granted access • certificate not surrendered or revoked Part-145 Part-M

  42. 145.A.95 Findings • From JAR-145 Maintenance Procedures Chapter 20 wording of Level 1 and 2 findings slightly changed but classification remains the same. (c) The maintenance organisation shall define and demonstrate corrective action to the satisfaction of the competent authority within a period agreed with the authority Part-145 Part-M

  43. Section B • Section B is applicable to the competent authority. • No significant change to existing oversight requirements. The text was derived from the existing JAA maintenance procedures. Part-145 Part-M

  44. 145.B.50 Findings • Action for Level 1 Findings • Immediate action shall be taken to revoke, limit or suspend, in whole or in part the approval, until successful corrective action has been taken • Immediate action means that the process starts so notification and time for appeal is allowed. • Action for Level 2 Findings • The corrective action period must be appropriate to the nature of the findings and not more than three months • A 3 month extension may be granted subject to a satisfactory corrective action Part-145 Part-M

  48. Regulation 2042/2003 Annex I (Part-M) Part-M Section A This section establishes the measures to be taken to ensure that airworthiness is maintained. It specifies the conditions to be met by persons or organisations involved in such continuing airworthiness management. Part-M Section B This section establishes Administrative requirements to by followed by the competent authorities in charge of the application and enforcement of Section A. Part-145 Part-M
