EASA: Remit • Its Remit: • Currently the Regulation 1592/2002 establishes Community competency only for the regulation of the airworthiness and environmental compatibility of products • Work is being done to extend the scope of this regulation to air operations and flight crew licensing • Ultimately it could also cover the safety regulation of airport operations and later to air traffic control services

EASA: REGULATION ORGANISATIONAL STRUCTURE • Full set of regulatory texts is available for initial and continued airworthiness. • Certification procedures are available for Products, Organisations and Guidelines for outsourcing
Rulemaking: Review of working groups • Liaising with Quality and Standardisation Directorate • In 2005 19 MAST and 7 POAST inspection visits took place. • In 2006 26 MAST and 16 POAST inspection visits are to take place. • Main findings are Eastern aircraft, Part M and Part 66 implementation. • Liaising with stakeholders • A part-M workshop was organised for general aviation. • 9 Part-145 local workshop have been organised in 2005 • A Part-66, Part-147 and Part M workshop have been organised in Cologne in April / May 2006 • Results of the RIA (NPA 07/2005) on Part-M (M-017) • An NPA proposing amendments for non-commercialaircraft has been published. Comment period has been extended at request of the General Aviation community. • Development of a revised EASA General rulemaking template including: • Set-up of rulemaking group MDM.032 to develop rules for non complex aircraft used in non-commercial operations • Work is underway to implement an Orphan Aircraft Policy
Rulemaking:Extension of the Agency’s scope • Developing opinions for IRs and decisions for AMC on OPS/FCL • Commission proposal was published on 15th November 05. The legislative process is under way. • Communication from the Commission on ATM and Airport published on 15 November 2005 • NPA published mid may 06

Operations, Licensing and Third Country Aircraft • Summary of the EC Communication -(1) • Essential Requirements covering pilot licensing and air operations introduced as additional Annexes to the Basic Regulation. • Commercial operations in the Community by third country operators shall be subject to Community legislation. • Third country aircraft, more or less permanently based in the territory of MS shall be subject to the same rules as EU registered aircraft. All third country aircraft operated by third country operators shall be subject to the same Community operational specifications as EU registered aircraft • All types of activities, encompassing commercial, corporate and recreational aviation shall be covered by Community legislation, except for the activities of aircraft listed in a slightly amended Annex II of regulation 1592/2002.
Operations, Licensing and Third Country Aircraft • Summary of the EC Communication –(2) • Commercial activities shall be subject to implementing rules covering pilot licensing and air operations and based on JAR-FCL and JAR-OPS 1, 3 and 4 and carried out at national level. • Non-commercial activities involving complex motor-powered aircraft shall be based on JAR-FCL and JAR-OPS 2 and carried out at national level, but air operators shall not be subject to a certification process, a simple declaration will suffice.
Operations, Licensing and Third Country Aircraft • Summary of the EC Communication –(3) • For non-commercial activities involving non-complex motor-powered aircraft (mainly general aviation and recreational activities): • A recreational PPL will be introduced as a “lighter” license and the Essential Requirements for operations will be directly applicable. • For non-commercial activities involving non-complex motor-powered aircraft (mainly general aviation and recreational activities): • Light implementing rules based on JAR-OPS 0 shall however be developed to mandate operational specifications. • Enforcement shall normally be at national level but the recreational PPL shall be issued by qualified bodies accredited by the Agency or NAA on the basis of common rules.
Operations, Licensing and Third Country Aircraft • Work in progress – (4) • General considerations • General EASA regulation template (GERT) – Under discussion • Implementing rules • Regulation of non complex aircraft not involved commercial activities (MDM-032) – Terms of reference adopted – Group has started. • Operations implementing rules (OPS-001) – Terms of reference to be published for consultation in the next weeks • Flight crew licensing implementing rules (FCL-001) – Terms of reference to be published for consultation in the next weeks • Implementation rule for third country aircraft– Terms of reference to be published for consultation by the end of September
Rulemaking: MDM-032 • State of work: startedMarch 2006; last meeting: 19/20 June 06 • July 2006: Publish interim report on the concept for regulatory system and implementation measures. • The interim report will be circulated as an A-NPA in accordance with article 14 of the Rulemaking procedures • March 2007: Issue Opinion to modify regulation (EC) 1592/2002 to introduce the new concept for airworthiness • Accelerated consultation process • March 2007: Issue Opinion to modify airworthiness implementing rules not linked to the change to regulation (EC) 1592/2002 • Accelerated consultationprocess
Rulemaking: MDM-032 • September 2007: finish • Elements for NPA for recreational private pilot licence rules. • Elements for NPA for general operational rules. • NPA to change airworthiness implementing rules and associated AMC linked to the change to regulation (EC) 1592/2002.
Rulemaking: M-017 • Part-M adopted on 28 November 2003 • Opt-out possible until 28 September 2008 • RIA carried out end 2004 early 2005 • NPA 7/2005 published and commented • The NPA concludes to the need to develop more AMC material (Task M-017) • The decision is taken to extend the role of the drafting group to • CRD to NPA7/2005 • Review the former JAR-66 B3 licence for light aircraft • Propose other changes to Part-M • Link with MDM-032 group
