  2. PERMOHONAN PERNYATAAN PAILIT BAGI PERSEKUTUAN YANG TIDAK BERBADAN HUKUM • PERSEKUTUAN FIRMA diatur dlm pasal : 16, 17, 18, 22 s/d 35 KUHD pasal 18 mengatur tentang tanggung jawab para sekutu. Persoalan tanggung menanggung tdp dlm psl 1278 dan pasal 1280 KUHPerdata. * dari psl 1278 dan pasal 1280 KUHPerdata dapat diketahui 2 macam perikatan tanggung menanggung (tanggung renteng), a.l:

  3. Perikatan tanggung menanggung yg bersifat aktif jumlah kreditor > satu b. Perikatan tanggung menanggung yang bersifat pasif  jumlah debitor > satu

  4. 2. PERSEKUTUAN KOMANDITER (CV) diatur dlm pasal 19 s/d pasal 21 KUHD NOTE : Firma a/ CV bukan suatu badan hukum (subjek hukum) maka dari itu firma a/ CV tdk dpt di jatuhi pailit
