The Issue • A teacher at the local high school found T.L.O and her friend smoking cigarettes in the bathroom. • Then the teacher took them to the principal. The principal looked in her purse and found a pack of cigarettes and rolling paper, which is associated with weed. • Then he continued to search the purse and found a pipe, weed, a lot of money and a list of students who owed her money.
Issue • They took it court saying that the search of her purse wasn’t legal and violated the 4th and 14th amendment.
The Decision • The court said that it didn’t violate any of the amendments because the school officials had special rights on school property. • They also said that the rolling paper that the principal saw gave them probable cause to search the rest of the purse.
Effects • This case has shown that while on school property, students lose some of their rights because the school has different rights than the government.
