Falls Lake Adaptive Implementation - .0275(5) • Monitoring - .0275 (5)(a) • Division shall perform WQ monitoring throughout reservoir • Shall accept WQ data by other parties • Must meet Division standards & quality assurance protocols • Evaluate use support determinations to judge progress • Segments listed in Sub-Items (5)(a)(i) - (5)(a)(vii)
Falls Lake Report to EMC - .0275(5)(b) • Report to EMC and public every 5 yrs starting in 2016 • Address uncertainties & advances in technology • Changes in nutrient loading to reservoir • State of wastewater and stormwater N&P control technology • Use & projected use of wastewater reuse & land application • Utilization of nutrient offsets & projected changes • Assessment of instream benefits of programmatic measurers
Falls Lake Report to EMC - .0275(5)(b) Continued • Results of any studies evaluating: • Changes in atmospheric deposition • Instream loading changes resulting from implementing rules • Loading from conventional septic systems and discharging SF • Loading from groundwater • Updates to nutrient loading accounting tools
Falls Lake Report to EMC in 2025 - .0275(5)(c) • Shall address the following • Physical, chemical, and biological conditions of Upper Lake • Whether alternative regulatory action is sufficient to protect • Impact on reservoir management on WQ in Upper Lake • Compliance methodology & potential for alt methods • Feasibility of achieving Stage II objective • Costs & Benefits of achieving Stage II objective
Falls Lake Reports to EMC - .0275(5)(d)(e) • The Division shall make recommendations, if any on rule revisions based on the information reported • In developing the reports, the Division shall consult with and consider information submitted by local governments and other persons with an interest in Falls Lake
Falls Lake Supplemental Modeling- .0275(5)(f) • A person may develop & submit a supplemental model based on additional data for EMC approval • Shall obtain Division review and approval of monitoring study plan & modeling framework • Shall meet Division requirements for data quality and model support/design • Supplemental model shall include a minimum of three years of lake WQ data
Falls Lake Supplemental Modeling- .0275(5)(f) • EMC May Accept modeling products that include: • Range of combination of N&P % load reductions needed to meet the goal of the Falls NMS • Allowable loads to Falls lake from the five upper subwatersheds • Division shall assure supplemental modeling is conducted in accordance with quality assurance requirements • EMC may initiate rulemaking to establish those allowable loads as the revised objective of Stage II
