  2. ZAKONSKI OPIS KAZNENOG DJELA NAPUŠTANJA NEMOĆNE OSOBE • Kazneno djelo protiv života i tijela • Čl.124. KZ • Tko nemoćnu osobu koja mu je povjerena ostavi bez pomoći u prilikama koje su opasne za njezin život ili zdravlje,kaznit će se kaznom zatvora do tri godine.

  3. NEMOĆNA OSOBA je osoba koja je „ostavljena bez pomoći”, tj. osoba koja nije u stanju vlastitom snagom,ili dozivanjem u pomoć trećih osoba,otkloniti opasnost po život ili zdravlje.

  4. OBILJEŽJA • mora biti konkretna situacija • napuštena osoba mora biti nemoćna prije nego što ju je počinitelj ostavio • opasnost mora biti konkretna i odnositi se na život ili zdravlje • pravo kazneno djelo nečinjenjem • za postojanje ovog KD nije potrebno prostorno odvajanje od nemoćne osobe • supsidijarno kazneno djelo
