Background DBE Achievement – Met Council PFA funded projects: 2006-2011 • Met Council Environmental Services (MCES) receives EPA financial assistance agreements through the Minnesota Public Facilities Authority (PFA) for professional / technical and construction projects • As the recipient of these funds MCES is required to follow EPA’s Disadvantaged Business Enterprise (DBE) program • The Met Council’s Office of Diversity and Equal Opportunity (ODEO) is responsible for: • Setting Met Council’s DBE Goals • Evaluating bids/proposals on MCES contracts that have goals • Monitor DBE program compliance through lifetime of contract
The EPA DBE Program DBE Achievement – Met Council PFA funded projects: 2006-2011 • Is not a quota or set-aside • Requires the contractor to break up or “de-bundle” contracts into small subcontracts • Requires prime to solicit bid/proposals from DBE firms • DBE firms are certified through the Minnesota Unified Certification Program (MnUCP) – approximately 600 DBEs • DBE Goal is further separated into Women Business Enterprise goal (WBE) and Minority Business goal (MBE)
MCES DBE Program DBE Achievement – Met Council PFA funded projects: 2006-2011 • MCES DBE program changed from WBE/MBE program to DBE program in 2009 • In July 2009 EPA approved MCES DBE program to: • Adopt USDOT DBE guidelines – provides a unified program for our vendors • Set own DBE Goals for agency • In July 2010, MCES set new DBE goals 10% WBE and 5% MBE – effective through 2013
MCES DBE Program cont. DBE Achievement – Met Council PFA funded projects: 2006-2011 • The low Bidder / Proposer for MCES contracts with goals pass the DBE evaluation by either: • Committing to meet the DBE goals (10% and 5%) by identifying DBEs and contract amounts at time of bid • Or • Demonstrating that they have performed “Good Faith Efforts” in attempting to find DBEs to meet the goal
DBE Achievement on MCES Contracts DBE Achievement – Met Council PFA funded projects: 2006-2011 • ODEO assigned DBE goals on 32 MCES contracts from April 2006 – April 2011 • Type of contracts • 14 contracts were professional / technical • 18 contracts were construction • Status of contracts • 12 completed / discontinued • 20 active
DBE Achievement on MCES Contracts DBE Achievement – Met Council PFA funded projects: 2006-2011 • ODEO has passed the bidder / proposer in the 32 contract based on: • Meeting the DBE goals – 18 contracts • Meeting the Good Faith Efforts – 14 contracts • Bidders / Proposers who passed by meeting the goal averaged 17.8% DBE commitment • Bidders / Proposers who passed by Good Faith Efforts averaged 9.4% DBE commitment
DBE Achievement on MCES Contracts • For Bidders / Proposers who passed DBE evaluation on Good Faith Efforts must provide documentation showing they: • De-bundled contract • Advertised subcontracting opportunities • Solicited quotes from DBEs • Awarded subcontracts to non-DBEs only when their bid was substantially lower • Since 2008, 4 low Bidders / Proposers have failed evaluation due to insufficient Good Faith Efforts • Of the 4: • 3 were awarded to 2nd low or successfully re-bid and met the goal / Good Faith Efforts • 1 was re-bid without PFA dollars (No goals) DBE Achievement – Met Council PFA funded projects: 2006-2011

DBE Achievement on MCES Contracts DBE Achievement – Met Council PFA funded projects: 2006-2011 • Value of 32 MCES contracts with DBE goals • $234,102,712 • Value of subcontracts, actual and committed, to DBE subcontractors • $21,715,298 (9.3%)
Improving MCES DBE Program DBE Achievement – Met Council PFA funded projects: 2006-2011 • ODEO and MCES Technical Services Department working together to better understand DBE market and plan projects appropriately • ODEO working with DBE community to increase bidding on MCES projects • ODEO and MCES working with Bidders / Proposers to better understand DBE program • Since 2009, percentage of bids / proposals that meet the goals at time of bid have increased to 65% (2006-08 – 52%)
