  2. Goal: Restoration of Hawaiian Sovereignty • Hawaiian nationals have a long history of resistance to the unjust occupation of their homeland. These efforts have ranged from a coup d’etat by supporters of the Hawaiian monarchy in 1895 as an attempt to overthrow the treasonous Provisional Government to hundreds of mele like Kaulana Na Pua written in protest. Another note worthy endeavor was the ability of nationals to secure the signatures of supporters of the monarchy in a petition denying the annexation of Hawai’i to the United States. This was a tremendous act of solidarity by the people of Hawai’i for out of a population of 45,000 approximately 38,000 supporters signed the Ku’e Petitions, which stopped the legal annexation of the islands. Recently in the history of resistance pertaining to the islands we have seen a resurgence of physical protest against illegal occupation as well as proliferation of pro sovereignty academia that has surged into the schools and courts as a powerful weapon against the usurpers. The following information pertains to such an academic endeavor that has influenced the International and U.S courts and thus the status quo of the U.S occupation of Hawaii.

  3. Dr. Keanu Sai a Ph.D. in Political Science specializing in Hawaiian Constitutionalism and International Relations, and a founding member of the Hawaiian Society of Law & Politics. Has put forth the thesis that Hawai‘i was not incorporated into the territory of the United States and is currently under an illegal and prolonged occupation. Because, The Hawaiian Kingdom was recognized as an independent and sovereign state since November 28, 1843 by joint proclamation of Great Britain and France and in 1849 by a treaty of Friendship by the United States.

  4. 1898 • The Hawaiian Kingdom came under military occupation on August 12, 1898 at the height of the Spanish-American War. The occupation reinforced and supplied the troops that have been occupying the Spanish colonies of Guam and the Philippines since May 1, 1898. Following the close of the Spanish-American War by the Treaty of Paris signed December 10, 1898 (30 U.S. • Stat. 1754), U.S. troops remained in the Hawaiian Islands and continued its occupation to date in violation of international law. • Illegally usurping Hawaiian sovereignty, President McKinley signed into United States law An Act To provide a government for the Territory of Hawai‘i on April 30, 1900 (31 U.S. • Stat. 141); and on March 18, 1959, President Eisenhower signed into United States law An Act To provide for the admission of the State of Hawai‘i into the Union (73 U.S. Stat. 4). These lawsnot only have no extraterritorial effect, but stand in direct violation of the 1907 Hague • Convention, IV, the 1949 Geneva Convention Relative to the Protection of Civilian Persons in Time of War, IV, and customary international law. • Imposing United States law is a usurpation of sovereignty of the Hawaiian Kingdom during occupation by the United States. Therefore, without a treaty of cession, the United States never secured the lawful succession of the Kingdom of Hawai’i and it’s lands and with that the right of jurisdiction to tax Hawaii Residts.

  5. Framing metaphors/Core message • Thus the United States and its agents continue to Illegally Occupy Hawaii while committing War Crimes against Hawaiians, as they illegally fund their criminal act thru the forced Illegal Taxation of All Hawaii Residents.

  6. Planned Action • Jonathan Chee currently as of 2/28/2013 has a demand for a cease and desist order against the Internal Revenue Service in regards to their notice to levy and collect taxes in the Kingdom of Hawaii. He has aquired the services of Dr.KeanuSai in this matter in which the Mr. Sai has drafted a letter to demand that the IRS stop its illegal activities in Hawaii pertaining to Mr.Chees case. Mr . Sai cites U.S Executive Agreements, Treaties betwen the U.S and Hawaii, international law, the Genewa and Hague conventions and the codes of war pertaing to the illegal occupation of Hawaii by the U.S in his cease and desist demand for Mr. Chee. Therfore, in support of Mr. Chee’s case this project is being initiated to plan a protest at the court house in the the possiblity that the case should go to court in Hawaii, the project will also incorporate within its scope a stratgy in regards to media, and public awareness and education.

  7. Education of partners and base • After careful discussion the conclusion has been made that supporters of the case need to provide a general education to the public in regards to the legal position of Hawaii according to International law. This should be based upon Dr. Sai’s expertise on the illegal occupation of Hawaii and how in particular it applies to the situation of the Chee case. • *People need to be notified that it is their rightful legal position to protest and stop the illegal acquisition and taxing of their property in Hawaii. A collection of emails needs to be gathered for the purpose of releasing updates and protest dates. • * This issue of taxation is applicable to every person in Hawaii regardless of Nationality and Racial origin. It is not particularly a political position but a legal position based upon jurisdiction and the lack there of by the United States. • Thus, interest and support can possibly be gathered amongst non Hawaiian Nationals in regards to the unfair taxation of their assets, thereby, gaining the support of other communities outside of the Hawaiian community.

  8. Education of partners and base • Research needs to be made to see if there are existing groups that are against illegal U.S taxation, which possibly be interested in working in partnership with the campaign. • 1. Civic clubs • 2. Sovereignty groups • 3. Anti taxation groups • 4. Disgruntled people who owe tax to the IRS. • a. Postings should be made in the newspapers and websites about case. • 5. Foreign nationals who are being illegally taxed • 6. Business in debt to IRS and being heavily taxed. • * Educational you tube video should be made. • * Educational website and blog should be made and maintained. • Media: • * Day of protest media needs to be informed on a national, international level • * Designated spokes people need to be chosen • * Message needs to be clear and determined • a. U.S is illegally occupying Hawaii • b. Illegal Taxation by IRS • c.War crimes are being committed by Judges. • d. U.S = War criminals • e. All people in Hawaii are being illegally taxed

  9. Logistics • Protest: • * In front of court house. • * Signs need to be made to be made with messages for media • * Notification of supporters and groups • * Designation of transportation and organization to site and back • * Notification schedule to email list months out from the date of protest, week out from the date of protest, day out from the date of protest, day of the protest.
